The City's obligation, how- <br />ever, shall cease five years after the trunk line construction is aut!: - ~~--_-: <br />In no event shall the City's share of the cost exceed 500/0 of the total cost <br />of the trunk line. <br /> <br />5. The following improvements or provision for improvements will be provided <br />with the City bearing that portion of the cost of the facility not needed to <br />serve the subdivision under consideration. <br /> <br />a. Clearirig, grading and base for street widths in excess of minimum <br />standards. <br /> <br />6. Each contract with the City will be subject to negotiation between the developer <br />and the City Council. In addition to the foregoing provisions. the following general terms will serve <br />as a basis for negotiation: <br /> <br />a. All construction shall be subject to City inspection and approval. <br /> <br />b. Street improvements to be provided either by the City or the developer <br />will be satisfactorily completed within time limits to be stipulated in the <br />contract. <br /> <br />c. Amount of streets to be opened in any section of the City will not exceed <br />reasonable needs. <br /> <br />d. Cost figures for facilities of which City will bear a portion of the cost, <br />paragraphs 3 and 4 above, shall be subject to City approval. <br /> <br />e. The City's portion of the cost of facilities provided per paragraphs <br />3 and 4 above shall be paid upon approval and acceptance. <br /> <br />Ownership and maintenance of improvements. <br /> <br />1. All street base, paving, curb and gutters, sidewalks, water and sewer systems. <br />street lights. street drainage systems within street right-of-way limits, street <br />marker signs and street survey monuments constructed or installed under the <br />provisions of this ordinance will become the property of the City upon com- <br />pletion and approval by the City of such construction or installation. <br /> <br />z. The City will be responsible for the future maintenance and replacement of <br />such improvements upon approval of the construction and satisfaction of any <br />agreements as may be in effect between the City and the Subdivider relating <br />to said construction. <br /> <br />- 17 - <br />
