<br />BE IT ORDAINED by the Council of the City of Martinsv111e, in
<br />regular meeting assembled, that Section I of Chapter IV, of the
<br />Health and Sanitation Code, titled Garbage Collection and
<br />Disposal, as amended, be further amended to read as follows:

<br />S]X;TION 1. GARBAGE COLLECTION AND DISPOSAL.
<br />
<br />A. It shall be the duty of every owner, agent, lessee, or other
<br />occupant of any premises, improved or unimproved, in the City of
<br />Martinsville wherein refuse shall be created, to provide or cause
<br />to be provided an adequate number of galvanized metal, water-
<br />tight, sanitary containers, each with a tight-fitting metal cover
<br />and side handles, of a minimum capacity of 20 gallons and a
<br />maximum capacity of 32 gallons. Such containers shall hold
<br />contents without leakage or spillage and containers shall be
<br />tightly covered at all times except when momentarily open to
<br />receive refuse or to have the contents removed.
<br />
<br />B. It shall be the duty of every ower, agent, lessee, or
<br />occupant to keep or cause to be kept clean and free from refuse
<br />all premises whether improved or unimproved, including lots and
<br />areas. All refuse shall be stored in containers that become so
<br />damaged or worn as to prevent tight closing of lids or the complete
<br />concealment of liquid \l8stes. Approved spring devices for securing
<br />lids shall be used on each refuse container except those used for
<br />the storage of ashes.
<br />
<br />c. Exception: Ashes shall be stored in smaller metal containers,
<br />the capacity of which should not exceed twenty (20) gallons. However,
<br />garbage or rubbish shall not be stored in ash containers.
<br />
<br />D. Refuse shall include the follo'Wing:
<br />
<br />1. Garbage: Putrescible animal and vegetable wastes resulting
<br />from handling, preparation, and consumption of foods.
<br />
<br />2. Rubbish: Non-putrescible solid \l8stes consisting of paper,
<br />cardboard, wood, tin cans, glass, yard clippings, bedding,
<br />crockery, metals, trash, sweepings, litter, and all other
<br />similar substances that become nuisances.
<br />
<br />3. Ashes: The residue from the burning of wood, coal, coke,
<br />or other combustible materials.
<br />
<br />E. All refuse shall be collected at frequent intervals and it shall
<br />be the duty of every O\l!1er, lessee, agent, or occupant of any
<br />premise within the City of Martinsville to place or cause to be
<br />placed refuse containers so as to be readily accessible to
<br />collection crews at ground level and not inside houses, porches,
<br />or garages. Bulky rubbish such as cardboard or 'WOoden boxes
<br />shall be flattened and, together with newspapers, magazine, and
