<br />j <br /> <br />TUESDAY <br /> <br />JUNE 11. 1957 <br /> <br />(b) UTILITY SERVICE: The Phrase "utility service" shall include <br />electricity service and/or water service furnished by the <br />City of Martinsville within its corporate limits. <br /> <br />(c) PURCHASERS: The word "purchaserlf shall include every purchaser <br />of electricity service and/or water service unless otherwise <br />specifically exempt by the City of Martinsville. <br /> <br />(d) The word SELLER: The word "sellerll shall mean the municipality <br />of the City of Martinsville who sells and furnishes such <br />utility services. <br /> <br />.w~..~~. <br />~~ <br /> <br />w <br /> <br />.3. There is hereby imposed and levied by the City of Martinsville <br />upon each and every purchaser of a utility service as defined <br />in Section 2 herein a monthly tax in the sum of One Dollar <br />($1.00) against the purchaser with respect of utility service, <br />which tax in every case shall be collected by the seller from <br />the purchaser and shall be paid by the purchaser unto the <br />seller for the use of the City of Martinsville at the time <br />that the purchase price or such charge shall become due and <br />payable under the agreement between purchaser and seller. The <br />fact that a purchaser shall purchase both electricity and water <br />from the seller shall not be construed as imposing a tax on <br />each utility service f'urnished by the seller to the purchaser; <br />that is to say, under this ordinance, the maximum tax to be <br />collected from a purchaser shall be one dollar ($1.00' per <br />month. <br /> <br />,r~ <br /> <br />Where there is more than one meter in one building and/or residence <br />and utility service is used exclusively by one and the same purchaser, <br />then there shall be only one tax levied for that purchaser. In <br />apartment buildings there shall be a tax levied for each apartment; <br />however, if the building owner resides in the apartment building, <br />then he or she shall pay only one tax for the serving of his or her <br />apartment and the hallway (including outside and basement). The tax <br />imposed or levied herein shall be in addition to the electric current <br />and power charges and/or water charges and. shall be placed on the bill <br />of each purchaser and current user in addition to the charges for <br />electric power and current and/or water charges and shall be payable at <br />the same time as electric, light, and power bills and/or water bills <br />are payable. <br /> <br />4. The United States of America, the State of Virginia, and the <br />political subdivisions, boards, COmmissions, and authorities <br />thereof are hereby exempt from the payment of the tax imposed and <br />levied by this ordinance with respect to the purchase of utility <br />service used by such governmental agencies. <br /> <br />5. Any purchaser failing, refusing, or neglecting to pay the tax <br />hereby imposed or levied shall, upon conviction, be subject to <br />a fine of not more than tan ($10.00) dollars; each failure, <br />refusal, neglect or violation and each day's continuance thereof <br />shall constitute a separate offense. And in addition to the fine <br />and penalties hereby imposed, the City Manager and/or person in <br />charge of the utility Service Department of the City shall, upon <br />the failure of any purchaser to pay the tax hereby levied or <br />imposed, discontinue electric light and power service and/or water <br />service to such purchaser. <br /> <br />--~~._-_.._----,-_._-,~, ---..------"- <br />
