<br />2~ <br /> <br />TUESDA Y <br /> <br />FF.BRUf~Y 28. 1961 <br /> <br />City Manager Hirst reported on several phases of the City's sewerage system <br /> <br />improvements program nevI underway, includinr: the follovring letter of proposal <br /> <br />to the Forest Park Country Club: <br /> <br />In accordance with the decision and direction of the Hartinsvil1e Citv <br />Council, in the joint meeting, on February 21, 1961, of tl:e City Coun~il <br />and re:oresentatives of your Board, the City of H'lrtinsvjl1e does hereby <br />subm::.t the follovring nroposal and offer to the Forest Park Country Club <br />in the matter of the construction by He City of its proposed Hulberry <br />Creek Interceptor SevIer Line across the property of the C011.TJ.try Club. <br /> <br />....- <br /> <br />Reference is made in this porposal to an easement agreement. This <br />refers to the draft of an easement agreement Vlhich Has fOTIrarded by <br />the City, under cover letter of February 10, 1961, to Er. Rives S. Brown,Jr., <br />with a coPy to Mr. 'Yl. T. Turner, Club President. <br /> <br />The City will: <br /> <br />1. Construct the sewer line, as to location, in accordance 1-lith detailed <br />plans referenced in the easement agreement. <br /> <br />2. Commence const~lction as early as practical after execution of <br />necessary easement and related agreement v;ith the co:rnmencement and <br />scheduling of construction to be consistent "nth the combination <br />of construction requirements and use of the course by Club membership. <br /> <br />3. Renair and improve the disturbed portions of the defined playing <br />areas as described in Section 2 of the easeme~t agreement. In brief <br />U:is arrangement '.-ril1 require the City to: <br /> <br />a. backfill and compact the ditches. <br />b. restore disturbed areas to original elevation. <br />c. remove excess excavation, etc. <br />d. hand-dress distlJrbed areas and apply perennial rye-grass seedi_ng. <br /> <br />4. Repair the disturbed portions of the defined non-playing areas as <br />described in Section 5 of the easement agreement. In brief this <br />arrangement Hill reauire the City to: <br /> <br />a. refill ditches and evenly distribute excess excavation. <br />b. regrade disturbed areas to smooth a~d even grade. <br />c. hand-rake disturbed areas and apply fertilizer, seed a~d lime. <br />d. remove and/or damage a minimum number of trees. <br /> <br />5. Accept and conform to all other provisions of the lease agreement. <br /> <br />6. Pay the Club the sum of Five Thousand Donars ($5,000) in consideration <br />of the nrivilege of the easement and of such maintenance expenses as may <br />be incurred by the Club by virtue of the construction nroject. <br /> <br />The Club ~..nll: <br /> <br />1. Seed and fertilize, as final seeding application, the disturbed portions <br />of th'" defined playing areas in accordance vrith the arrangement described <br />
