<br />2f <br /> <br />THUH.S DAY <br /> <br />FEBR JflRY 16-, 1961 <br /> <br />,"--'" <br /> <br />the Club will meet Februa.-ry 20th to consider a draft of a proposed agreement in <br /> <br />connection with easement required by the City; whereupon, Council indicated it would <br /> <br />convene in special meeting upon receipt of the Board of Director's action upon the <br /> <br />proposed agreement, to consider and act thereon. <br /> <br />Upon motion, duly secondeci and unanimously carried, Council amended--by ordinance, <br /> <br />,,- <br /> <br />as follows-its "Animal Ordinan::e" adopted March 22, 1960, to provide and require the <br /> <br />an:1ual issuance, by the DeDartment of Health, of pern'_ts required in said ordinance: <br /> <br />BE IT ORDAINED by the Council of the C it,y of Ma:tiJ1Sville, Virginia, in regular <br />meeting assembled, that Section 2-4 of Chapter 2, Part II of the Code of the <br />City of Martinsvil1e be and is hereby a'llended to provide as follows: <br /> <br />Sec. 2-4. Keeping livestock and fowl vdthi.'1 the City. <br /> <br />(a) It shall be unlawful to keep or maintain any hog, pig, goat or <br />sheep .within the corporate limits of this City. This section shall not <br />prohibit the transportation of such ani.'llals t.trough the City. <br /> <br />Any person, firm, or corporation now keepin[; such animals in <br />violation of this provision shall have twelve months from March 22, 1960, <br />to corrmly with the provisions hereof, after ~.illich time such person, firm, <br />or corporation so failing to comply with this ])C'ovision shall be subject <br />t.o the penalties hereinafter set forth. <br /> <br />..- <br /> <br />(b) Except as herein otherwise provided, it shall be unlawful for <br />any person, firm, or corporation to koep within the corporate limits of <br />tne City any horse, mule, cow, chicken, turkey, duck, or other like <br />animal class:Lfied as livestock or fowl except such animal or fowl be <br />confined in an enclosed pen, cage, or stable not closer than a distance <br />of two hundred feet to any dwelling or to any building occupied for <br />bus iness purpOSC~3, and provided the owner or keeper of such animal or <br />fowl has be on iS~3Ued a permit by the director of public health to keep <br />such animal or fowl in the manIler herein stipulated. Permits issued by <br />the director of Dublic health can be valid for not longer than one year <br />and can be issued only after receipt of application submitted by the <br />owner or keeper of such animal or fowl intended to be kept in the manner <br />herein prescribed; and Drovided, fur'ther, that each initial application <br />must be accompan:i.ed by the written C onsent--to the keeping of such <br />animal or fOl'll--of every adult person resicUn[; or doing business within <br />a distance of three hundred feet from the location of any pen, cage, or <br />stable. Each renew;:-,l application may be required to be accomoanied by <br />the written consent specified for each initial application. <br />
