<br />~68 <br /> <br />TH"lJRSDAY <br /> <br />FEBRUAIIT 16~ 1961 <br /> <br />Any enclosure in which such animal or fowl are kept and maintained <br />pursuant to such permit shall be kept in a clean and sanitary condition <br />to the satisfaction of the director of public health. M2nure in vvhich <br />flie~J breed or are likely to breed is hereby declared to be a nillsance <br />and detrimental to public health. The natural presence of fly larvae <br />in manure shall be evidence that flies are breeding therein. Any pel's on, <br />firm, or corporation owninr, or maintain:Lnl!, any enclosure for the keeping <br />of such animal or fowl shall comply .with such methods and procedures as <br />may be provided by the director of public health or his representative <br />for the control or elimination of flies and rodents. <br /> <br />Any person, fjrm, or corporation nOVi keeping any horse, mule, cow, <br />chicken, t1..lI'key, duck or other like an:Lmal or fowl in violation of the <br />limitations as to distance under the provisions of this Section shall <br />be allowed to continue to keep such animal or fowl, so long as the <br />keeping is othervdse lawful, subject to the follovring provisions: <br />(1) Such person, firm, or corporation must annually make <br />application to the director of public health for a non- <br />cOY1~orming permit to keep such an animal or fowl, such <br />permit to be granted if the director of public health is <br />satisfied that such enclosure, in which such animal is <br />kept and maintained, is in a clean 2nd sanitary condition. <br /> <br />(2) Such applicant shall comply vd.th the provisions of <br />Section 2-4 (c) and (d) hereinafter set forth. <br /> <br />(c) Except as otherwise provided in this ordinal1ce, the director <br />of public health or his representative shall administer this ordina.nce, <br />inc luding the receiving of applications for permits, the inspection of <br />permises and the issuance of permits. No pernit of occupancy shall be <br />is,;uc,} by h:L':1. unless the applicant complies -\vi th the provisions of this <br />orcl.inance. <br /> <br />Applications for either a permit of occupancy or a non-conforming <br />permit shall be made upon application forms supplied by the director of <br />public health and shall be accompanied by a fee of One Dollar ($l.OO). <br /> <br />In applying far' a permit under this section, the applicant thereby <br />authorized the ciirector of public health or his representative to enter <br />upon the premises as often as he deems advisable to determine the sani- <br />tary condition of such promises and to d3 tcrmine if the provisions of <br />this section are being violated. <br /> <br />Permits issued by the director of public health pursuant to the <br />provisions of this ordinance shall expire JLme 30th of each year unless <br />other>vise revoked. <br /> <br />Nothing in this ordinance shall be construed to eliminate the <br />necessity of compliance .with the BuildinC and Zoning Codes of the City <br />of Martinsville. <br /> <br />
