<br />52 <br /> <br />TUESDAY <br /> <br />AUGUST ll, 1959 <br /> <br />(2) Immediately after the gas mains and pipes are installed or <br />repaired, the tranches in which said gas mains and pipes are located shall <br />be refilled by the Grantee. Back filling of trenches shall consist of <br />placing earth in layers not to exceed six inches in depth with each layer <br />thoroughly tamped with approved air or hand tampers. The material for <br />backfilling shall be earth, free from large lumps, stones, and other <br />objectionable matter, and shall contain only enough moisture to readily <br />compact to the density of the original earth. Non-suitable and surplus <br />trench naterial shall be removed by the Grantee. 'vThere necessary, tempo- <br />rary surfacing shall be placed in such excavations as soon as the same <br />has been backfilled. Pavement, sidewalks, curbs, gutters, or other <br />portions of streets or public places destroyed, disturbed or damaged by <br />such work shall be promptly restored and replaced with like materials to <br />their former condition by the Grantee at its own expense, however, where it <br />is necessary in order to achieve fomer condition, to use materials whose <br />type, specifications or quantities exceed or are different than as used in <br />the original construction or installation, then the Grantee at its own <br />expense shall provide such different materials. Villere a cut or disturbance <br />is made in a section of sidewalk paving, rather than replacing only the area <br />actually cut, the Grantee shall replace the full width of the existing walk <br />and the full length of the section or sections cut, a section being as <br />marked by expansion joints or scoring. The restoring of the pavement, side- <br />walks, curbs, gutters, and other portions of streets shall be done in <br />accordance with specifications of the City, if any, and shall be subject to <br />inspection by the City. The City Council may require the Grantee to notify, <br />in any or all cases, the Director of Public Works, or his agent, in writing <br />immediately after the aforesaid work has been completed. The Grantee shall <br />maintain, repair and keep in good condition for a period of one year follow- <br />ing such disturbance all portions of streets and alleys disturbed by it or <br />its agents. The Grantee shall promptly remove or correct arw obstruction or <br />defect in any street, alley, or other public place which may be caused by <br />the Grantee or its agents in the operation or maintenance of the Granteefs <br />prorerties. Arw such obstruction or defect which, after proper notice to the <br />Grantee directing removal or repair as the case may be, is not properly <br />removed, repaired, or corrected by the Grantee, shall be remedied by the City, <br />and the costs thereof shall be charged against the Grantee and shall be paid <br />within a period of thirty (0) days after presentation of a bill therefor. <br />Expense of damage to, or relocation or replacement of City utility lines, <br />sanitary sewers, storm sewers, and storm drains, where such expense results <br />from construction or maintenance of the Granteefs lires or facilities; shall <br />be borne by the Grantee and any expense incurred in connection therewith by <br />the City shall be reimbursed by the Grantee. <br />(3) The Grantee shall not open or disturb or encumber, at any om time, <br />any more of such public streets than may, in the opinion of the Director of <br />Public Works, be reasonably necessary to enable it to proceed with advantage <br />in laying or repa:iring its gas mains and pipes. Neither shall the Grantee <br />permit any such street, sidewalk, alley, highway or public place, so opened, <br />disturbed or encumbered by it in the mstallation, construction, or repair <br />of its gas mains or pipes, to remam open or the public way disturbed or <br />encumbered for a longer period of time tl1an shall, in the opinion of the <br />Director of Public Works, or other proper official of the City, be reasonably <br />necessary. In all cases where any such highway or other public place shall <br />be excavated, disturbed or encumbered by the Grantee, the Grantee shall take <br />all precautions necessary or proper for the protection of the public and shall <br />maintain adequate warning signs, barricades, signals, and other devices <br />necessary or proper to adequately give notice and warning to the public of the <br />existence of all actual conditions present. <br />
