<br />r <br />t <br /> <br />TUESDAY <br /> <br />AUGUST 11, 1959 <br /> <br />- <br /> <br />- <br /> <br />(4) Whenever the City shall pave or repave any street or shall change <br />the grade or line of any street or public place or shall construct or reconst- <br />ruct any conduit, water main, sewer or water connection, or other municipal <br />public works or utility, it shall be the duty of the Grantee, when so ordered <br />by the City, to change its mains, services, and other property in the streets <br />or public places at its own expense so as to conform to the established grade <br />or line of such street or public place and so as not to interfere wi. th the <br />conduits, sewers, and other mains as constructed or recorntructed. However, <br />the Grantee shall not be required to relocate pipes, mains and appurtenances <br />when the street, alley, or public ground, in which they are located, is <br />vacated for the convenience of abutting property ovmers and not as an incident <br />to a public improverrent, unless the reasonable cost of such relocation and the <br />loss and expense resulting therefrom is first paid to the Grantee. <br />(5) The City may at its discretion assign personnel for inspection or <br />supervision of excavation and related work being performed by the Grantee. <br />Subsection (c). Extension on non-public street. <br />Where any gas line is presently or in the future laid anywhere in the corporate <br />limits of the City, as now constituted or as hereafter extended, not in a public <br />street and a street shall thereafter be opened or dedicated so as to include <br />said line within the right-of-way of such street, said gas line shall be <br />required to be operated ani maintained under the terms of this Ordinance. <br /> <br />Section 8. Rates. The Grantee shall supply gas to consumers wi thin <br />the City at reasonable -rates. It is recognized that under the statutes of the <br />Commonwealth of Virginia the State Corporation Commission is vested with legal <br />authority to supervise, fix or change rates and charges authorized to be charged <br />by the Grantee to consumers of natural gas. It shall also be recognized by both <br />the Grantee and the City that matters involving rate charges and changes are <br />local in their application and effect and that the City through its City C oun::il, <br />shall be within its privileges and municipal responsibilities in making inquiries, <br />expressing interest or adopting position in matters of rate charges or changes <br />of the Grantee. Simultaneously with the filing by the Grantee of arw application <br />or petition or request in aIW form with the State Corporation Commission, or aIW <br />other regulatory body invested by law with authority and jurisdiction to <br />authorize change of rates and charges, for an increase in or authority to <br />increase rates or charges, or for any revision or change which would have the <br />effect of increasing the rates and prices to be paid to the Grantee by consumers <br />of natural gas in the City, the Grantee shall file with the City Manager of the <br />City a written notice stating that it intends to make such application for a <br />rate increase. The notice to the City Mamger shall state in a clear and <br />defin.i.te way the amount of such increase of rate to be requested as applied to <br />each class of consumer use. <br /> <br />Section 9. Reports. The Grantee shall each year file with the City <br />Manager a true copy of the annual audit of the records of the Grantee as the <br />records pertain to the operations or conduct of b'llsiness by the Grantee under <br />this franchise. The audit may be the same as the Grantee shall have prepared <br />by certified public accountants for such year in the ordinary course of the <br />conduct of the business of the Grantee. <br /> <br />Section 10. Acquisition by City. <br />Subsection (a). The City shall have, and the Grantee by the acceptance of <br />this Ordinance e),..-pressly grants to the City, the right, at the expiration of <br />this franchise, to acquire the property, equipment, books and records of the <br />
