<br />Section 5. Obligation of Grantee to Furnish Natural Gas. <br /> <br /> <br />Subsection{a) Except to the extent that the Grantee shall <br /> <br />be prevented from doing so by order or rules and regulations of the <br /> <br /> <br />Federal Power Commission or the State Corporation Commission, the <br /> <br /> <br />Grantee will deliver to and distribute for the use of the inhabitants <br /> <br /> <br />within the City, during the period of this franchise, and providing <br /> <br /> <br />there is a demand for same, not less than one million, five hundred <br /> <br /> <br />thousand cubic feet per day of natural gas of the heating value and <br /> <br />pressure herein elsewhere defined unless the Federal Power Commission <br /> <br />or other regulatory body having jurisdiction and authority to do so <br /> <br /> <br />shall reduce the allocation of natural gas to the Grantee for distri- <br /> <br />bution in the City. In the event such allocation is so reduced then the <br /> <br /> <br />Grantee will deliver to and distribute within the City for the use <br /> <br /> <br />of the inhabitants thereof, if and when demanded, the maximum quantity <br /> <br /> <br />possible under the reduced or altered circumstances. In the event <br /> <br />the Grantee should file or make application to the Federal Power Com- <br /> <br /> <br />mission, or other regulatory body having jurisdiction, for a reduction <br /> <br />in all~cation of natural gas to the Grantee for distribution in the <br /> <br /> <br />City, the Grantee shall simultaneously with such filing or application <br /> <br /> <br />give written notice to the City Council of such action and purpose. <br /> <br /> <br />Subsection{b). In the event the supply of natural gas <br /> <br /> <br />available, allocable or allocated to the Grantee is increased beyond <br /> <br />the amount presently allocated to it under the order of the Federal <br /> <br /> <br />Power Commission, or other authorized governmental agency, the Grantee <br /> <br />shall allocatE and distribute to the inhabitants and consumers within <br /> <br /> <br />the City, each time such available supply is increased, if there is <br /> <br />then a demand for more natural gas in the City, a fair ratable share <br /> <br /> <br />of such increased supply. <br /> <br />- 3 - <br />
