;6

TUESDAY

DECEMBER 28, 1965

Mr. R. R. Young, Jr., and other members of the Martinsville-Henry County Bar

Association, presented the following resolution--which Council endorsed and

adopted--requesting the establishing by the 1966 Virginia General Assembly of

a Corporation Court for the City of Martinsville:

WESREAS, the Seventh /(icial Circuit of Virginia is composed of the
Counties of Patrick and Henry and the City of Martinsville, having a
combined population as of July 1, 1964 of over 80,000 people; and

WHEREAS, the commercial development in this area has been phenomenal
in recent years and has brought to this Circuit five large shopping
centers and related business establishments necessary to accommodate
the influx of population, which comes not only from areas included
in the Seventh Judicial Circuit, but from surrounding counties and
from the State of North Carolina; and

WHEREAS, the growth of business and influx of population has created
a substantial increase in the work load of the Court for this area,
both in civil and criminal matters; and

WHEREAS, the case load for the courts in this Circuit in 1964 was as
follows:

Commenced

Concluded

Henry County
Martinsville
Patrick

1 , 287
1,142
310
2,739

1 ,231
1,047
~
2,597

and from all indications and available surveys the total corresponding
figures for 1965 will be increased over 1964; and

~IEREAS, the Seventh Judicial Circuit record of 2,739 cases commenced in
1964 ranks second in the Commonwealth, only to the Sixteenth Judicial
Circuit consisting of five (5) judges with a total load of 4,587 cased
commenced, or an average of 918.2 cases per judge; and

~1EREAS, there exists in the Commonwealth at the present time one 5-judge
circuit, one 3-judge circuit and seven 2-judge circuits, as well as
numerous Corporation, Hustings and other courts, and it is apparent that
the judge of this Circuit has the greatest case load in the State; and

W~EREAS, the judge of this Circuit, making use of all available day-time,
of necessity must consider chancery matters at night; still our docket has
gotten to a point where we are approximately 12 months behind in reaching
civil cases for trial, the result of which creates a severe hardship on
litigants, the Court and its officials; and, with the case load of the
Court increasing rapidly year by year, and because of the expansion and
development of the area, this condition will become more acute with the
passage of time; and

""",__,~,_____"_"",,__,,__,,~__,,,""""~M"'~.""''"'''''''' ._.....,..,
