<br />~54 <br /> <br />TUESDAY <br /> <br />SEPTEMBER 28, 1965 <br /> <br />By memorandum report dated September 24, 1965, City Manager Hirst reviewed <br /> <br /> <br />events relating to the construction by the City of sewer lines within <br /> <br /> <br />areas annexed to the City as of January 1, 1960, which construction <br /> <br />did not take place until after the effective date of this annexation <br /> <br />and extended until December 13, 1962. These events also related to <br /> <br />contracts with Lanier Farm, Inc., dated February 10, 1958; April 28, 1958; <br /> <br />and December 18, 1959; and to the provisions therein requiring Lanier Farm, <br /> <br />Inc., to be responsible for the construction and financing of all utilities <br /> <br />and improvements referred to in said contracts. For reasons cited in <br /> <br />Mr. Hirst's report, it was not practicable for Lanier Farm to construct <br /> <br />the sewer lines required, especially inasmuch as the City prior to <br /> <br />annexation was not able to construct outfall lines to serve these areas. <br /> <br />The report further informed Council that the total cost of the linGS <br /> <br />attributable to the aforesaid contracts was $37,153.13, which cost the City <br /> <br />paid its contractor as a portion of major contract projects, and that the <br /> <br />developer owned 38 abutting street-lots at date of completion of line <br /> <br />construction as compared with the number of 131 lots owned prior to <br /> <br />annexation, forming a ratio of 131 :38 or 29.01% of the lots which directly <br /> <br />benefitted from the sewer line construction. This percentage applied to the <br /> <br />total applicable cost of $37,153.13, if this basis of approach were to be <br /> <br />used in settlement of the question, would require Lanier Farm to pay <br /> <br />$10,778.12 to the City for its IIbenefitted" share. Council unanimously <br /> <br />indicated its approval of this approach and this basis of settlement, <br /> <br />assuming that Lanier Farm is agreeable to this pro-rata settlement. <br /> <br />Council deferred action--pending further study--on a petition submitted <br /> <br />by Mr. J. S.
