<br />3~ <br /> <br />TUESDAY <br /> <br />APRIL 13. 1965 <br /> <br />the proposed extension of Fairy Street across Northside Drive; and (2) on the <br /> <br />petition submitted to Council, also on February 9, 1965, by Mr. T. J. Childress, <br /> <br />Jr., requesting a IIP-1 Professionalll zoning classification for a tract of land <br /> <br />lying immediately north of and adjacent to the above-referred-to six-acre tract. <br /> <br />The Commission reported further that it is withholding action on these two <br /> <br />petitions because of the following facts: <br /> <br />1. That the two tracts under consideration for rezoning are not a <br />part of an approved subdivision and to this date have not actually <br />been cut off from the entire tract owned by Lester Lumber Company; <br /> <br />2. That the two properties in question have no frontage on a public <br />right-of-way for a dedicated street space; <br /> <br />3. That prior to development of the properties in question that a <br />subdivision must be made which would include a dedicated street <br />space, presumable the extension of Fairy Street, by the properties <br />in question and improvements provided on this street in accordance <br />'tJith the requirements of the subdivision ordinance of the City of <br />Ma::'r~ insville, VirginjJl; <br /> <br />4. That to the date of its meeting on April 6, 1965, no evidence had <br />been seen or heard by the Commission that such a subdivision is <br />being planned; and <br /> <br />5. That, ignoring the above facts, there are currently no water and <br />sewer facilities immediately available to serve these two properties. <br /> <br />By report dated April 9, 1965, the Planning Commission recommended IIthat all <br /> <br />property having frontage on the south side of East Church Street between <br /> <br />Cleveland Avenue and Starling Avenue be rezoned from its present R-6 Residential <br /> <br />classification to a P-2 Pro~essional classification for.. ..full depth!', this <br /> <br />recommendation being in response to the request filed with Council on February <br /> <br />9, 1965, by heirs of the Jones Estate property at 320 East Church 'Street, for a <br /> <br />IIP-1 Professionalll zoning classification of that property. Councilman T. J. <br /> <br />Burch reported that Mrs. F'. V. Woodson and Mrs. W. M. Whittle have expressed a <br /> <br />preference that their properties within this block not be rezoned. In tentatively <br /> <br />accepting the Commission's recommendation, Council called for a public hearing <br /> <br />on same to be held at Council's regular meeting scheduled for May 11, 1965. <br />
