AN ORDINANCE IMPOSING AND LEVYING A MONTHLY TAX ON THE USERS OF WATER AND ELECTRICITY, WITHIN THE CITY OF MARTINSVILLE, FOR THE SUPPORT OF THE CITY GOVERNMENT, THE PAYMENT OF PRINCIPAL AND INTEREST ON THE CITY DEBT, AND FOR OTHER HUNICIPAL PURPOSES; PROVIDING FOR THE COLLECTING OF SAID TAX; AND PROVIDING PENALTIES BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MARTINSVILLE 1. STATEMENT OF POLICY - It is the purpose and poliCy of the City of Vartinsville in enacting this ordinance imposing a tax on the users of electricity and water within the City of ~artinsville to equalize, as far as practicable, the burden of taxation among its citizens. 2. DEFINITIONS: The following words and phrases, when used in this ordinance, shall, for the purpose of this ordinance, have the following respective meanings except where the context clearly indicates a different meaning. (a) The word "person" shall include individuals, firms, partnerships, associations, corporations, and combinations of individuals of whatever form and character. (b) UTILITY SERVICE: The phrase "utility service" shall include electric service and/or water and sewer service furnished by the City of ~~rtinsville within its corporate limits. (c) PURCHASERS: The word "purchaser" shall include every purchaser of electric service and/or water and sewer service unless otherwise specifically exempt by the City of Martinsville. (d) The word SELLER: The word "seller" shall mean the municipality of the City of 11artinsville who sells and furnishes such utility services. 3. There is hereby imposed and levied by the City of Nartinsville upon each and every purchaser of a City utility service, as defined in Section 2 herein, a monthly tax in accordance with the following schedule: (a) on every purchaser of a City utility service, the sum of one dollar ($1.00); (b) in addition to the foregoing, on every purchaser of electric service the additional sum of: (1) one dollar ($1.00) where the monthly electric service charge does not exceed ~10.00; (2) one dollar and fifty cents (11.50) where the monthly electric service charge exceeds $10.00 but does not exceed $20.00; and (3) two dollars (~2.00) where the monthly electric service charge exceeds $20.00. Such tax or taxes in every case shall be collected by the seller from the purchaser and shall be paid by the purchaser unto the seller, for the use of the City of 11artinsville, at the time that the purchase price or such charge of charges shall become due and payable under the regulations of the City of Martinsville.
