<br />34 <br /> <br />TUESDAY <br /> <br />DECEMBER 15, 1964 <br /> <br />Indicating concurrence with the costs to be assumed by the City, and upon <br /> <br />motion by Vice-Mayor Fred T. Renick, seconded by Councilman E. E. Stone, Council <br /> <br />unanimously adopted the following resolution requesting that the Knollwood Place- <br /> <br />Lanier Road area petition be tried by an Annexation Court composed of the Resident <br /> <br />Judge of the Seventh Judicial Circuit Court only, being Judge Hooker: <br /> <br />.- <br /> <br />THAT -WEEREAS there is now pending in the Circuit r')urt of Henry County <br />a suit, the style of which is Lucy B. Andrews, et als, vs. the City of <br />Hartim:ville, Virginia, et als, filed by petitioners seeking the annexation <br />of 279 acres, more or leE:s, of Henry County territory to the City of <br />Hartim:ville, Virginia, in which suit the City of Martinsville has filed <br />an answer stating that it believes the territory set out in said petition <br />onght to be annexed to said City; <br /> <br />NOW, THEREFORE, be it reE;o1 ved that the Council of the City of Martinsville, <br />Virginia declares that the necessity for an expediency of the annexation <br />of the territory described in the pending case of Lucy B. Andrews, et als, <br />vs. the City of Martinsville, Virginia, et als, exists and that such <br />annexation should be decreed, and pursuant to the provisions of Title <br />15.1-1038 of the Code of Virginia, requests that this case be tried by an <br />Annexation Court composed of the Resident Judge of the Seventh Judicial <br />Circuit only. <br /> <br />A letter of petition dated December 11, 1964, submitted by Robert K. Kitson and <br /> <br />Alta T. KitE:on as intended purchasers of property located at 307 East Church <br /> <br />Street (owned by Mr. John W. Townes), and requesting the rezoning of said <br /> <br />property from IlR-6 Residentialll to IlC-2 CommerciaJ1' to permit the operation of <br /> <br />a hair fashion center at this address, was referred to the Planning Commission <br /> <br />for its com,ideration and recommendation. <br /> <br />Council was adjourned. <br /> <br />),'~~ -- - <br />W.
