34 TUESDAY DECEMBER 15, 1964 Indicating concurrence with the costs to be assumed by the City, and upon motion by Vice-Mayor Fred T. Renick, seconded by Councilman E. E. Stone, Council unanimously adopted the following resolution requesting that the Knollwood Place- Lanier Road area petition be tried by an Annexation Court composed of the Resident Judge of the Seventh Judicial Circuit Court only, being Judge Hooker: .- THAT -WEEREAS there is now pending in the Circuit r')urt of Henry County a suit, the style of which is Lucy B. Andrews, et als, vs. the City of Hartim:ville, Virginia, et als, filed by petitioners seeking the annexation of 279 acres, more or leE:s, of Henry County territory to the City of Hartim:ville, Virginia, in which suit the City of Martinsville has filed an answer stating that it believes the territory set out in said petition onght to be annexed to said City; NOW, THEREFORE, be it reE;o1 ved that the Council of the City of Martinsville, Virginia declares that the necessity for an expediency of the annexation of the territory described in the pending case of Lucy B. Andrews, et als, vs. the City of Martinsville, Virginia, et als, exists and that such annexation should be decreed, and pursuant to the provisions of Title 15.1-1038 of the Code of Virginia, requests that this case be tried by an Annexation Court composed of the Resident Judge of the Seventh Judicial Circuit only. A letter of petition dated December 11, 1964, submitted by Robert K. Kitson and Alta T. KitE:on as intended purchasers of property located at 307 East Church Street (owned by Mr. John W. Townes), and requesting the rezoning of said property from IlR-6 Residentialll to IlC-2 CommerciaJ1' to permit the operation of a hair fashion center at this address, was referred to the Planning Commission for its com,ideration and recommendation.
