J44

TUESDAY

DECEMBER 15, 1964

extending of Madison Street by the developers to Brookdale Street in accordance

with the City's Subdivision Regulations.

City Manager Hirst reported that the final decree or court order, directing

the annexing to the City of properties cited in petitions of Lanier Farm, Inc.,

and of the Whittle Trust as of January 1, 1965, as referred to in Council's

minutes of October 1, 1964, has been agreed to by counsel for all parties

concerned and is awaiting the signatures of the three judges of the special

Annexation Court.

City Manager Hirst also reported that by resolution of December 14, 1964, the

Henry County Board of Supervisors voted not to oppose the annexation petition

filed September 28, 1964 by residents of the Knollwood Place-Lanier Road area

and, further, said Board is reported in agreement with factual data being

presented to Judge John D. Hooker, Judge of Henry County Circuit Court, as a

basis upon which this area should be annexed to the City and with the cost

which would be assessed against the City, which cost is predicated upon, and

in keeping with, the formula used in determining the City's assessment in the

Lanier Farm-Whittle Trust cases. Assuming that the Knollwood Place-Lanier Road

area petition would not require a special court hearing and that this area would

become annexed also as of January 1, 1965, the total cost to be paid by the City

to the County of Henry was listed as follows:

Lanier Farm Whittle Trust Knollwood-
Lanier Road Totals
Revenue Loss" $ 4, 189 . 50 $ 25,054.20 $ 65,984.00 $ 95,227.70"
School Debt;H~ 3,633.62 23,900.60 62,388.27 89,922.49H
Totals: $ 7 , 823 . 12 $ 48,954.80 $128,372.27 $185,150.19

,,- Payable in equal annual installments of $19,045.54 over period of five years.

,p, Due and payable by January 1, 1965.
