<br />~40 <br /> <br />TUESDAY <br /> <br />DECEMBER 8. 1964 <br /> <br />City Manager Hirst informed Council that he and other representatives of the <br /> <br />City will confer with State Highway officials in Richmond, December 9th, on <br /> <br />various phases of the City's street improvement program and as it relates to <br /> <br />the Highway Department's program, with special emphasis on the extending of <br /> <br />Northside Drive and on prospects and plans for the construction of a new road <br /> <br />outside the City's southwest corporate limits and its effect on the constructing <br /> <br />by the City of a sewer line which generally would follow the Smith River basin <br /> <br />along the duPont plant property. <br /> <br />Mr. and Mrs. Harold E. Wilson, of 730 Craig Street, andMr . William N . Richey, <br /> <br /> <br />of 732 Craig Street, appeared before Council not only in the interest of a <br /> <br /> <br />sewer line along Rugg Creek but also in connection with the matter of removing <br /> <br />a boulder from Rugg Creek, which has not yet been done but waS authorized by <br /> <br /> <br />Council on September 17, 1964 to be done by City personnel, upon the condition <br /> <br /> <br />that these residents--by written agreement--save the City harmless. Council <br /> <br /> <br />waS advised that the Richeys and Wilsons have not executed such an agreement, <br /> <br /> <br />as prepared by City Attorney Cubine, thus prohibiting the City from proceeding <br /> <br /> <br />with the removal of the boulder. The Richeys and Wilsons contended that the <br /> <br /> <br />City contemplates using dynamite to break up the boulder and, therefore, they <br /> <br />have withheld execution of the proposed agreement, further contending that the <br /> <br />use of dynamite would be unnecessary. The danger of damaging property through <br /> <br />the use of air-hammers was also pointed out; whereupon Council directed the <br /> <br />City to proceed with the work by using sledge-hammers or like means only, <br /> <br />provided ingress and egress is given City personnel. <br /> <br />City Manager Hirst reported that Continental Can Company, by letter, has <br /> <br />assured the City that it will continue to operate its local plant at its <br /> <br /> <br />present site along Stultz Road for at least two more years and that, with <br /> <br />_M"'"",~,',"._______'__'_'_~.~__~'__"M'__'__"'____" <br />
