<br />2() <br /> <br />TUESDAY <br /> <br />NOVEMBER 26, 1963 <br /> <br />Other persons present speaking in behalf of the petition were: Attorney <br /> <br />Douglas K. Frith, representing the Sally Earley Estate heirs; Mr. Lawrence <br /> <br />Earley, one of the seven heirs of the Earley Estate; and Mr. Rieves s. <br /> <br />Hodnett, whose firm (Burch-Hodges-Stone) is real estate agent for the <br /> <br />Earley heirs. Also in support of the petition was the following letter <br /> <br />presented by Mr. James B. Hall, residing at 100 Randolph Street, on behalf of <br /> <br />.- <br /> <br />several owners of residential property near the proposed shopping center: <br /> <br />The undersigned wish to state their position relative to the <br />shopping center that is proposed for construction by W. B. <br />Leverton and Associates between Church Street and Madison <br />Street in the East Martinsville area. <br /> <br />First, we would like to see the property re-zoned to allow the <br />construction of the shopping center. However, there are certain <br />safeguards that we feel we would be entitled to as neighboring <br />property owners and residents. <br /> <br />We respectfully propose to Council of the City of Martinsville <br />that the property be re-zoned as requested, provided: <br /> <br />(1) That there be a 25-foot strip of land fronting on Madison <br />Street running the entire distance from Booker Road to Brookdale <br />Street which will remain in a residential classification. <br /> <br />(2) That the 25-foot strip be planted and maintained with a <br />hedgerow of evergreen trees and shrubs which would act as an <br />effective screen between the street and the shopping center <br />property. <br /> <br />".-.., <br /> <br />(3) That no entrances or exists to the shopping center property <br />be located on Madison Street. <br /> <br />It is our understanding that Mr. Leverton is in general agreement <br />with the above, but we would like to have some official understanding <br />so that we are protected. <br /> <br />Opposing the petition were Attorneys W. R. Broaddus, Jr., John Epperly, and <br /> <br />W. R. Broaddus, III, of the law firm of Broaddus, Epperly and Broaddus, who <br /> <br />.- <br /> <br />represented a number of owners of business property in the "downtownrt area, <br /> <br />claiming that local shopping facilities are presently adequate; that the proposed <br /> <br />rezoning would be in conflict with that recommended by the Planning Commission <br /> <br />in the new Zoning Code now under consideration; and that such a shopping center <br />
