<br />Mr. Stafford G. Whittle, III, by letter reqU3sted that he be replaced as a
<br />member of the City Planning Commission upon the expiration of his present
<br />term, ending July 1, 1962.
<br />
<br />Mr'. J. English Ford, Attorney and counsel for Mr. & Mrs. C. E. Taylor, Jr.,
<br />
<br />and for the heirs ofE. E. Givens, appeared before Council and requested
<br />
<br />Cou:rx:il's sanction of the vacating and abandonment of a thirty-foot alley
<br />
<br />between the Taylor and Givens properties fronting on the west side of Thomas
<br />Heights, these properties being identified as Lots #5 and #6, which alley has
<br />
<br />been designated as for the sole use of the owners of these two lots by deeds
<br />
<br />to these properties; Whereupon Council unanimously gave its approval to said
<br />
<br />vacation and abandornnent--initiated by Attorney Ford under Section 15-766.1
<br />
<br />of the CODE OF VlRGINIA, 1950, and as amended-by authorizing City Manager
<br />
<br />Hirst to execute the followi~ instrument:

<br />THIS AGREEMENT, made th is 8th day of M~, 1962, by and between
<br />the CITY OF MARTINSVILIE, VIRGINIA, a Municipal Corporation, party
<br />of the f:irst part, and CLAUDE E, TAYLOR, JR. am HElEN F, TAYLOR,
<br />husband and wife, parties of the second part, ani ANNIE LOU DELP
<br />GIVENS, Widow of E. E. Givens, Deceased, and RICHARD N, GIVENS and
<br />CURTIS D, GIVENS, the sole surviving he irs of E. E. Givens, Deceased,
<br />parties of the tb ird part:

<br />WITNESSETH: That Whereas, the parties of the secorn and third
<br />part are the owners of all of the property abutting the hereinafter
<br />described alley-way running from the West side of Thomas Boulevard
<br />to the East side of Woodland Street, which alley space has rever been
<br />opened to the public nor used as a public thoroughfare; and
<br />
<br />Whereas, the parties of the second arrl third part have petitioned
<br />the Council of the City of Martinsville, Virginia, for the abandoDllent
<br />and vacation of the hereinafter described alley-way; and
<br />
<br />Whereas, the Council for the City of Martinsville, Virginia, is
<br />authorized by virtue of Section 15-766.1 of the C ode of Virginia, as
<br />amended, to apIX'ove the abandornnent or vacation of the aforesaid alley
<br />space; and
<br />
<br />Whereas, the Council for the City of Martins'lli.lle, Virginia, at
<br />a meeting held on the 8th day of :Mew', 1962, did vote to approve the
<br />abandornnent or vacation of said alley space;
