<br />FRIDAY <br /> <br />MAY 4. 1962 <br /> <br />----- <br /> <br />Arter further discussion, upon motion, duly seconded, and by a recorded vote, <br />Council unanimously declared that an emergency exists and so stated in the <br /> <br />unanimous adoption of the following ordinance requesting the court of <br /> <br />jurisdiction to order the re-establishment of the City's corporate boundaries <br /> <br />in accordance therewith I <br /> <br />IN THE COUNCIL OF THE CITY CF <br /> <br />-. <br /> <br />MARTTISVIIJE, VlRGINJl <br /> <br />The 4 day of May, 1962 <br /> <br />AN CRDINA1<<:E to petition the Oircuit Court of Henry County, Virginia, <br />pursuant to the provisions of Chapter 8, Title 15, of the Code of <br />Virginia, 1950, 1956 Replacement VOlume, as amended for the annexation <br />of certain territory lying and being in Henry County, Virginia; setting <br />forth the necessity for and expediency of such annexation and the metes <br />and bounds and size of such area; to indicate genEn'ally the subdivisions, <br />the farm areas, the vacant areas, the residential areas, and the <br />industrial areas and others sought to be annexed, together with any <br />other general information deemed relevant as to the possible future uses <br />of the property within the annexation area; to state generaJ.J.y the <br />terms and conditions upon vhich annexation is sought and the provisions <br />planned for the future improvement of the annexed territory, including <br />provisions for public utilities, and services therein; and to authorize <br />the institution and oonduct of the necessary legal proceedings to <br />effectuate said annexation. <br /> <br />- <br /> <br />BE rr ffiDAINED by the Council of the City of Martinsville as follows: <br />1 . That the City of Martinsville hereby declares that it is necessary <br />and expedient to annex, in pursuance of the provisions of Chapter 8, <br />Title 15, of the Code of Virginia, 1950,1956 ReplacEll1ent VOlume, as <br />amended, certain territory in Henry County adjacent to the present <br />corporate limits of the City of Martinsville. <br /> <br />2. The territory of the County of Henry to be acquired by the proposed <br />annexation, is accurately described by the following metes and bounds: <br /> <br />BEGINNING at a point said point being in the s~ right-of-way line <br />of Spruce Street (formerly Old Danville Road) and also being 481.92 <br />feet east of the intEn'section of Corn Tassel Trail and Spruce Street, <br />said point being also in existing City Corporate limit line; thence <br />with the southern margin of the Old Danville Road as it meanders in <br />an easterly direction 4200 feet, mOre or less, to where Mulberry Creek <br />crosses said road; thence continuing with the south margin of the <br />Old Danville Road 1420 feet, more or less, to the northeast corner of <br />the propEn'ty of Le.n1er Farm, Inc.; thence with the IaniEn' Farm, Inc., <br />property in a southerly direction, following an area show as "reserved" <br />on General Plan for Sulxiivision of Lanier Farm, Inc., prepared by E. S. <br />Draper and Associates, August, 1938, said original map being of record <br />in the Henry County Circuit Court Clerk's Office in Map Book 114; Page 11214, <br /> <br />,- <br />
