Highway 220 and known as site No. 7 as shown <br />on plans prepared by Norfolk and 'Western Railway C omparw, April <br />12, 1962, am be it identified that the commitment for the <br />provision of utilities as provided in this resolution shall be <br />as to this site, and the Mayor is hereby authorized and directed <br />to execute the aforesaid option farthwi tho <br /> <br />BE IT FURTHER RESOLVED that the entire tr~lCt of approxinately <br />238 acres knavrn as the City's Airport ?roperty be dedicated for <br />and restricted to industrial development. <br /> <br />Further, Council adopted the following resolution authorizing the conveying <br /> <br />of fee simple title of necessary right-of-way to the Norfolk & Western <br />by <br />Railway Company for the constructing! the Norfolk (,: Western Railway Comparw <br /> <br />of n lead tracks n into the airport property, if industrially developed: <br /> <br />WHEREAS, the Council of the City of Martinsville, during a <br />special meeting of the Coun::il held May 1, 1962, by resolution <br />has made certain commitments in connection with the proposed <br />industrial development of its property known as the nairport <br />tractll; and <br /> <br />vVHEREAS, t[~ Council has been advised that the Norfolk & Western <br />Railway Company desires to construct rail facilities into this <br />property i~ industrially developed; <br /> <br />Nan, Tl-JERJ':FORE, BE IT RESOLVED by the Council of the City of <br />Martinsville, Virginia, in special and duly-called meeting this <br />first day of May, 1962, that it does herein and hereby signify <br />to the Nerfolk "( Wesc~ern Railway Company that, in the event <br />the airport tract is developed for industrial usage and in the <br />event the Norfolk & Western Ra~lway Company desires to construct <br />and will construct rail facilities to serve industrial customers <br />within the property, the City of Martinsville 'will deed, with <br />fee simple title, to the Norfolk c:. Western Railway Company <br />rights-of-way for industrial lead tracks, subject to the <br />following general conditions: <br /> <br />Such rights-of-way shall be a mlnlIDum of twenty (20) <br />feet in width together with right of s lope for cuts <br />and fills and shall be generally located as shown on <br />Dra~~ng l-D10-l, dated April 12, 1962, as prepared <br />by the Norfolk & ';'iestern Railvray Co:npany, with final <br />location of these rights-of-way to be determined by <br />mutual agreement of the Narfolk & Western Railway <br />Company and the City of Martinsville, by survey to <br />be made by the Norfolk & Western Raibvay Company. <br /> <br />The conveyance by the City of rights-of-way and the <br />constrl1ction by the railway conpany of tracks shall <br /> <br />
