( , I
~,

TUESDAY

AUGUST 26, 1969

Mr. Herbert P. Dillon, residing at 402 Minor Street, appeared before Council

in behalf of the Minor Street curb-and-gutter petition on file, informing

Council that--a1though one of the twelve property owners involved will not

participate financially but the other eleven will absorb the cost--this petition

will now qualify for curb-and-gutter construction whereas, heretofore, not

enough interest was evident. Council asked that this petition be included for

Council's review and consideration during the selection of projects for the

1970-71 budget year.

At City Manager Noland's request, Council continued for consideration the

microfilming equipment proposal presented at its August 12th meeting.

Pursuant to the following report and recommendation of the Planning Commission,

Council granted to Mr. Garrett Wells permission to receive water service at

a new commercial building (under construction) at the intersection of C1earview

Drive and Route 57, outside the City's corporate limits:

The Planning Commission, at its meeting on Thursday, August 21, 1969,
gave further consideration to the Wells & Donavant petition for water
service to a commercial building at the corner of C1earview Drive and
Chatham Road in Henry County.

--

Following consideration of this matter, the Commission voted to
recommend to Council that this petition be granted, subject to the following
conditions:

1. That the contract for water service include covenants limiting the
use of this property to those uses allowed in the C-1 Commercial zone
in the City Zoning Ordinance.

2. That the setbacks required for any buildings on the property be as
indicated on a new plan attached hereto.

--

3. That any buildings erected on the property be subject to the City
Building Code and any other application ordinances of the City.

4. That some recognition be given in the contract to the fact that
C1earview Drive may necessarily be widened at some future date and
that it might be necessary to utilize the majority of the approximate
16-1/21 setback the new building will observe.

wq
