<br />",1; ~ <br />~ \, <br /> <br />TUESDAY <br /> <br />JULY 22, 1969 <br /> <br />WHEREAS, Martinsville City Council conducted a duly-advertised public <br />hearing on said petition at its regular meeting held July 22, 1969, at <br />which time no one registered any objections to said proposed closing; <br />now, therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsvil1e, Virginia, in <br />regular meeting assembled this twenty-second day of July, 1969, that-- <br />in acceptance of the reports and recommendations of both the Martinsvi11e <br />Planning Commission and the Board of Viewers--it doth hereby order the <br />discontinuance and abandonment of said portions of "D" Street, viz., <br />between Fourth Street and Roundabout Road, subject to the reserving of <br />utility easements through said portions ordered closed; and <br /> <br />BE IT FURTHER ORDAINED that a copy of this ordinance be forthwith filed <br />with the Clerk of the Corporation Court of the City of Martinsvi11e, <br />Virginia, as authorization for said Clerk to mark his records according <br />hereto. <br /> <br />In acceptance of--and pursuant thereto--the following recommendation of the <br /> <br />Planning Commission, Council denied the rezoning request (filed May 27, 1969 <br /> <br />by Mr. Charles A. Womack, Executor of the Estate of Dr. C. T. Womack) involving <br /> <br />the C. T. Womack Estate property at 18 Starling Avenue: <br /> <br />The Martinsvi11e City Planning Commission conducted a duly advertised public <br />hearing on Thursday, July 17, 1969, on a matter referred to them by Council. <br />This matter was a petition submitted by the Heirs of the C. T. Womack property <br />at 18 Starling Avenue, requesting that this property be rezoned from its <br />present P-2 Professional to a C-2 Commercial classification. The Commission <br />also at this time heard evidence from all property owners in the area with <br />regard to the possibility of rezoning the entire block bounded by Church <br />Street, Starling Avenue, Brown Street and Cleveland Avenue to a C-2 <br />Commercial zone. However, there was much opposition to both the petition <br />and to rezoning the entire block. <br /> <br />Following this public hearing, the Commission with siz members present, and <br />Member Childress abstaining, voted to recommend to Council that the petition <br />for rezoning be denied. <br /> <br />The Commission felt that it could not recommend the spot zoning of the <br />Womack property to C-2 Commercial and that the area in question is not yet <br />ready for commencia1 zoning inasmuch as there is no demand for the property, <br />and there is much opposition to such a rezoning. <br /> <br />The Commission would point out that all except one property of those <br />properties fronting the east side of Cleveland Avenue between Brown Street <br />and Church Street are presently zoned as P-2 Professional. Also, that all <br />properties fronting the south side of Church Street, with the exception <br />of the property at the corner of Cleveland Avenue and the property owned <br />by the Womack Estate on Starling Avenue, are presently zoned P-2 Professional. <br /> <br />The Commission respectfully submits the above recommendation for Council's <br />further consideration. <br />
