<br />Be <br /> <br />TUESDAY <br /> <br />DECEMBER 10. 1968 <br /> <br />,- <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this tenth day of December, 1968, that <br />Section X (Group Housing Developments) of the City's Subdivision <br />Ordinance be, and is hereby, amended to include the following addition, <br />to be identified as Paragraph "c" thereof: <br /> <br />".,,~ <br /> <br />C. Unified Development. <br />Those Unified Developments allowable under the Zoning Ordinance, <br />Section VIII, Paragraph C, together with necessary drives and ways <br />of access, may be approved by the Commission although the design of <br />the project does not include standard streets, lot and subdivision <br />arrangements, if departure from the foregoing standards can be made <br />without destroying their intent. <br /> <br />Mr. Charles J. Nooe, Attorney at Law and Counsel for The Twin-City Grocery <br /> <br />Company, which operates a wholesale grocery at 212 Franklin Street (here in <br /> <br />M3.rtinsville) as well as two similar establishments in North Carolina, appeared <br /> <br />before Council in connection with the recent rezoning petition filed by this <br /> <br />firm and "tabled" by Council upon recommendation of the Planning Commission. <br /> <br />Mr. Nooe informed Council that changes in the corporate structure of his <br /> <br />client's firm are contemplated but no changes in either the conduct of the <br /> <br />business or its physical facilities are anticipated; therefore, his client <br /> <br />seeks assurance that the conduct of this business will continue to be <br /> <br />permitted under the non-conforming provisions of the City's Zoning Ordinance. <br /> <br />City Attorney Cubine indicated--and Council concurred--that, from Mr. Nooe's <br /> <br />explanation, the contemplated change in the firm's corporate structure <br /> <br />would have no bearing on the provisions of the Zoning Ordinance and that, <br /> <br />so long as the firm complies with these provisions, non-conforming conduct and <br /> <br />usage would be permitted. <br /> <br />In tentative acceptance of the Planning Commission's recommendation for <br /> <br />approval of the rezoning petition recently filed by Rich Oil Sales, requesting <br /> <br />"C-3 Commercial" zoning of its properties at the intersection of Clearview <br /> <br />Drive and Liberty Street and, also, the properties fronting the east side of <br /> <br />Liberty Street between Clearview Drive and the Northside Sport Shop, Council <br /> <br />directed that a dUly-advertised public hearing on this matter be <br />
