<br />I () () <br /> <br />TUESDAY <br /> <br />DECEMBER 10. 1968 <br /> <br />conducted at Council's meeting scheduled for Tuesday, January 14, 1969. <br /> <br />With reference to a petition filed by Mr. Roy C. Stone with Council on <br /> <br />October 22, 1968, requesting the amending of the City's Zoning Ordinance <br /> <br />to allow drive-in theaters within the corporate limits, the Planning <br /> <br />Commission presented the following report and recommendation which Council <br /> <br />unanimously accepted, thus denying said petition: <br /> <br />Your Planning Commission conducted a public hearing on Tuesday, <br />December 3, 1968, with regard to a petition submitted by Mr. Roy <br />C. Stone, requesting that the Zoning Ordinance be amended to allow <br />drive-in theaters in the City of Martinsville. <br /> <br />Much opposition was encountered at this public hearing to amending <br />the Ordinance and also to the proposed location of a drive-in off <br />~3morial Boulevard to the rear of Frank's Food Fair where there now <br />exists a golf driving range. The opposition cited the following <br />factors: <br /> <br />1. The moral impact on the community. <br />2. Heavy traffic generation at night and its accompanying <br />congestion. <br />3. Detriment to property values in the neighborhood around the <br />theater. <br />4. Generation of noise. <br /> <br />Following due consideration of the facts presented and evidence heard <br />at this public hearing, the Commission, with five of its seven members <br />present, voted unanimously to recommend to Council that this petition <br />be denied. The Commission felt that evidence presented was insuffici- <br />ent to justify amending the Ordinance as petitioned on the basis of <br />public necessity, the promotion of public safety, health, convenience <br />or general welfare. <br /> <br />The Planning Commission respectfuIlf submits the above recommendation <br />for Council's further consideration. <br /> <br />Council, also, acknowledged the presence of a number of citizens who--through <br /> <br />their representatives (Mr. Jackson L. Kiser, Attorney at Law, and Mr. J. E. <br /> <br />"Tommy" Clark)--registered their objections to the petitionerfs request as <br /> <br />well as their concurrence with the Planning Commission's recommendation. <br />
