<br />i (t <br />J' ~ f <br /> <br />TUESDAY <br /> <br />JUNE 25, 1968 <br /> <br />WDEREAS, the City of Martinsville, Virginia, desires to construct <br />and maintain sewer pipelines crossing the right-of-way of the <br />Carolina & Northwestern Railway Company at six separate locations, <br />involving a City sewer line construction project generally <br />identified as 11Jones Creek Interceptor11; and <br /> <br />WHEREAS, said Carolina & Northwestern Railway Company agrees-- <br />insofar as its title enables it so to do--to permit said pipeline <br />crossings located substantially as follows: <br />(1) Shown in red color on print of Drawing marked 11Exhibit A11 <br />and identified as crossings #5 and #6; <br /> <br />(2) Shown in red color on print of Drawing No. 4-295, dated <br />August 23, 1967, identified as crossings #2, #3, and #4; and <br /> <br />(J) Shown in red color on print of Drawing marked "Exhibit A11 <br />and identified as crossing #1; <br />now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this twenty-fifth day of June, 1968, <br />that the Honorable F. T. Renick, M.D., Mayor, be--and is hereby-- <br />authorized to execute agreements (being three in number, covering <br />aforesaid crossings) with said Carolina & Northwestern Railway Company. <br /> <br />By fee simple deed authorized by the following resolution, Council conveyed <br /> <br />to the Department of Highways of the Commonwealth of Virginia an area of .98 <br /> <br />acre within the City's Industrial Park alongside existing Route 976, to <br /> <br />enable the Department of Highways to improve and/or relocate portions of <br /> <br />said Route 976: <br /> <br />WHEREAS, the Department of Highways of the Commonwealth of Virginia <br />contemplates the improving and re-aligning of Route 976, including <br />a portion of said route extending for a distance of some 1,200 feet <br />from Norfolk & Western Railway Company property westward within the <br />City's Industrial Park; and <br /> <br />WI{EREAS, to accomplish such improvement and re-alignment, said <br />Department of Highways requires possession and title to .98 of an <br />acre of land owned by the City of Martinsville and near or adjacent <br />to the existing Route 976; and <br /> <br />WHEREAS, the Council of the City of Martinsville, Virginia, desires <br />to cooperate in this matter by donating said required right-of-way <br />through fee simple deed; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this twenty-fifth day of June, 1968, <br />that the Honorable F. T. Renick, M.D., Mayor, be--and is hereby-- <br />authorized to execute said deed conveying said property to the <br />Commonwealth of Virginia, Department of Highways. <br />
