<br />; \.j' \./ <br />.. t (J <br /> <br />TUESDAY <br /> <br />MAY 14, 1968 <br /> <br />City of Martinsville in lieu of its present gross receipts license tax.1I <br /> <br />Pursuant to duly-advertised public notice, Council conducted a public hearing <br /> <br />on petition of Mr. Stafford G. Whittle, III, denial of which petition has <br /> <br />twice previously been recommended by the Planning Commission, requesting the <br /> <br />rezoning of property at 604 Starling Avenue from IIR-611 to IIC-3", on which <br /> <br />property it is proposed to construct and operate a 117-11" store. Messrs. <br /> <br />James H. McFarland and F. E. Sites, residing at 709 and 707 Starling Avenue, <br /> <br />respectively, appeared before Council in opposition to the proposed rezoning <br /> <br />although indicating no opposition if the entire area along Starling Avenue <br /> <br />were so rezoned. A representative of other citizens in the area inquired <br /> <br />as to plans for the widening of Starling Avenue, response to which revealed <br /> <br />no such plans in the near future. As heretofore expressed before Council, <br /> <br />Mr. Whittle (petitioner) reviewed the action of the Planning Commission, in <br /> <br />which denial of the petition was recommended by a vote of three-to-two, being <br /> <br />five of the seven-member Commission. A poll by Mr. Whittle of the entire <br /> <br />seven members indicated a vote of three-and-three on this matter, with the <br /> <br />seventh member being undecided, thus constituting reason for Mr. Whittle's <br /> <br />contention that Council should decide upon this matter. Upon motion, duly <br /> <br />seconded and carried, Council effected said requested rezoning by adopting <br /> <br />the following motion, including therein reference to a suggested IIturn-Ianell <br /> <br />for vehicular traffic: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this fourteenth day of May, 1968, that <br />the City's Zoning Code and Zoning Map be, and are hereby, amended <br />to reclassify--for zoning purposes--to IIC-3 Commercialll that property <br />located at the northwest corner of the intersection of Starling <br />Avenue and Spring Street, which property fronts along the west side <br />of Starling Avenue for a distance of approximately 103 feet and <br />extends parallel to the north side of Spring Street for a distance <br />of approximately 125 feet. <br />
