<br />')j <br />..... ...:. <br /> <br />TUESDAY <br /> <br />DECEMBER 26, 1967 <br /> <br />City Manager Noland presented the following letter (dated December 12, 1967) <br /> <br />,- <br /> <br />from Mr. K. L. Wright, Highway Right-of-Way Engineer for the Virginia <br /> <br />Department of Highways, in connection with the City's interest (evidenced <br /> <br />by option held by the City, dated September 15, 1967, for ninety days but <br /> <br />subsequently extended to December 27, 1967) in purchasing from Childress-West, <br /> <br />Inc., for the total sum of $12,500.00, that property located at the southwest <br /> <br />corner of Brown and Ellsworth Streets, for future street right-of-way: <br /> <br />This is to confirm our telephone conversation on December 11, 1967, <br />relative to the City's desire to acquire the captioned property and be <br />assured of state participation at such time a portion, or possibly all, <br />of this property is needed for a future Highway project. <br /> <br />This is to advise that it will be satisfactory for the City of <br />Martinsville to acquire this property at this time, insofar as the <br />Commonwealth is concerned; however, the extent of our participation <br />cannot be established until such time as the property has been appraised <br />by two (2) Fee Appraisers. By a copy of this letter to our District <br />Right of Way Engineer in Salem, we are requesting that he have a <br />representative contact you in the next couple of days to outline the <br />procedures which must be followed in having the subject property <br />appraised. <br /> <br />Once the property has been appraised in accordance with the procedures <br />which will be outlined by our representative, the appraisals are to <br />first be reviewed by the City, then by our District Review Appraiser <br />in Salem, and, finally, approved by this office. <br /> <br />,- <br /> <br />In the event the appraisal figure, which is approved, exceeds the <br />$12,500.00 cost to the City, the State will participate in the total <br />amour.t of $12,500.00, at such time as the property is needed for a <br />Highway project. If the appraisal figure is approved for a lesser <br />a:rnour.t than $12,500.00, the Commonwealth, at the time the property is <br />needed for a project, will only participate in the amount of the <br />approved appraisal. If, when the plans eventually materialize, only a <br />portion of the property is needed for construction, we will only <br />participate in the portion which is actually needed. <br /> <br />It is to be understood that the Commonwealth will not participate in <br />any costs incurred in connection with the acquisition of this property <br />until such time as the property is necessitated by a Highway project. <br /> <br />Upon motion, duly seconded and unanimously carried, Council directed that the <br /> <br />option be exercised as per terms and conditions therein and, accordingly, that <br /> <br />the property be acquired. <br />
