~ I (' ;;':-J) TUESDAY DECEMBER 26, 1967 The regular semi-monthly meeting of the Council of the City of Martinsville, Virginia, with Mayor F. T. Renick, M.D.; Mayor, presiding, was held Tuesday, December ;26,1967, beginning at 7:30 P.M., in the Council Chamber, City Hall, all members being present, viz., Mayor F. T. Renick, M.D.; Vice-Mayor E. E. Stone; Harry L. Boaz; W. Donald Hartford; and Francis T. West. After the invocation, Council approved as recorded the minutes of its regular meeting held December 12, 1967. In connection with the establishing of a Law Library (in the new City Hall) under Section 42-19.4 of the CODE OF VIRGINIA (1950, and as amended), the ordinance introduced at Council's meeting held December 12, 1967, to provide for such a library, and erroneously recorded as having been adopted at said December 12th meeting, was considered on second reading and then unanimously adopted, effective January 1, 1968, as follows: BE IT ORDAINED by the Council of the City of Martinsville, Virginia, that the sum of one dollar ($1.00) shall be assessed, as part of the costs, incident to each civil action filed in both the courts of record and the courts not of record in the City of Martinsville, pursuant to Section 42-19.4 of the CODE OF VIRGINIA (1950, and as amended); and BE IT FURTHER ORDAINED that the assessment herein provided and imposed shall be collected by the clerk of the Court in which the action is filed and such collections shall be remitted at the end of ea.ch month to the treasurer of the City of Martinsville, to be deposited and held by such treasurer subject to disbursements authorized by the City Council--or its agent--for the acquisition of law books and law periodicals for the establishment, use, and maintenance of a law library, which library shall be open for the use of the public, and for such other purposes allowed by said Section 42-19.4; and BE IT FURTHER ORDAINED that the assessment herein provided and imposed sha.ll be in addition to all other costs prescribed by law but shall not apply to any action in which the Commonwealth of Virginia or any political subdivision thereof or the federal government is a party and in which the costs are assessed against the Commonwealth of Virginia, or any political subdivision thereof, or the federal government; and BE IT FURTHER ORDAINED that this ordinance shall be in effect on and after January 1, 1968.
