') j TUESDAY DECEMBER 12. 1967 filed in the courts of record and courts not of record located within the boundaries of the City of Martinsville, Virginia, the sum of $1.00 to be used as provided in said Section for the acquisition of law books and periodicals and for the establishment, maintenance and use of a law library which shall be open for the use of the public; in addition to the acquisition of law books and periodicals and the establishment of a law library, such sums as are derived from the above assessment may be paid to librarians or other necessary staff for the maintenance of such library and the acquisition of suitable quarters for such library. In connection with this Petition and in accordance with the above mentioned Section, the sums collected shall be paid to the Clerk of the Court in which the action is filed and remitted to the Treasurer of the City of ~lrtinsville for the above use to be disbursed by this governing body. With the understanding that the Henry County Board of Supervisors would act favorably upon a sirrrilar petition soon to be presented, Council unanimously adopted the follow- ing ordinance requiring the assessing of the sum of one dollar ($1.00) as a part of the costs incident to each civil action filed in the courts of record and courts not of record located in the City of Martinsville, effective January 1, 1968, for the purpose set forth in the foregoing petition and pursuant to Section 42-19.4 of the CODE OF VIRGINIA (1950, and as amended): BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular meeting assembled this twelfth day of December, 1967, that the sum of one dollar ($1.00) shall be assessed, as part of the costs, incident to each civil action filed in both the courts of record and the courts not of record in the City of Martinsville, pursuant to Section 42-19.4 of the CODE OF VIRGINIA (1950, and as amended): and BE IT FURTHER ORDAINED that the assessment herein provided and imposed shall be collected by the clerk of the court in which the action is filed and such collections shall be remitted at the end of each month to the treasurer of the City of Martinsville, to be deposited and held by such treasurer subject to disbursements authorized by the City Council--or its agent--for the acquisition of law books and law periodicals for the establishment, use, and maintenance of a law library, which library shall be open for the use of the public, and for such other purposes allowed by said Section 42-10.4; and BE IT F'URTHER ORDAINED that the assessment herein provided and imposed shall be in addition to all other costs prescribed by law but shall not apply to any action in which the Commonwealth of Virginia or any political subdivision thereof or the federal government is a party and in which the costs are assessed against the Commonwealth of Virginia, or any political subdivision thereof, or the federal government; and BE IT FURTHER ORDAINED that this ordinance shall be in effect on and after January 1, 1968.
