<br />nf~ <br /> <br />TUESDAY <br /> <br />JULY 25. 1967 <br /> <br />Having recently viewed the various streets for which petitions for curb-and- <br /> <br />gutter and/or sidewalk construction have been received, Council appr~ved the <br /> <br />schedule of such construction for the current fiscal year, as presented and <br /> <br />as previously given tentative approval. <br /> <br />Mr. Robert N. McLean, Special Justice for the Corporation Court of the City <br /> <br />of Martinsville, appeared before Council in support of his letter dated July <br /> <br />24, 1967, in which he cited reasons for his request for increase in compensation <br /> <br />allowed in processing commitment petitions; whereupon, Council unanimously <br /> <br />accepted Mr. McLean's proposed compensation schedule of $75.00 per month for <br /> <br />himself as Special Justice, and $20.00 per case for each of the two medical <br /> <br />doctors required and $20.00 per case for the attorney required, effective <br /> <br />July 1, 1967. <br /> <br />Upon being informed that the City's agent and right-of-way negotiator has <br /> <br />exhausted all available means within his authority, and without success, to <br /> <br />acquire rights-of-way from Messrs. George W. Wells and Vernon W. Peters to <br /> <br />permit the construction of a sewer line for the purpose and in the area hereinafter <br /> <br />d3scribed, Council adopted the following resolution authorizing City Attorney <br /> <br />Cubine to institute condemnation proceedings against these two property <br /> <br />owners to acquire said rights-of-way: <br /> <br />WHEREAS, the agent and right-of-way negotiator for the City of <br />Martinsville1s sewerage system improvement program has informed the <br />Council of the City of Martinsville that he has exhausted all available <br />means within the limitations of his authority, and without success, to <br />acquire rights-of-way from George W. Wells and Vernon W. Peters, owners <br />of properties situated betweeD a point near or adjacent to the City1s <br />Industrial Park and the City's Sewerage Treatment Plant, all being south <br />of the south side of Smith River, in Henry County, Virginia, which <br />rights-of-way (involving a total length of approximately 1,137 feet) <br />are necessary to the constructing of a sewer line to connect the <br />present "Machine Brook" sewer outfall line, serving said Industrial <br />Park, and the City's Sewerage Treatment Plant; now, therefore, <br />
