<br />~U) <br />1-'-:21- '\ <br /> <br /> <br />TUESDAY <br /> <br />FEBRUARY 14. 1967 <br /> <br />necessary to enter into a contract with City Transit Company, Inc., as lessee, <br /> <br />for the use, operation, and maintenance of these busses in the local public <br /> <br />transportation system; whereupon motion, duly seconded and unanimously carried, <br /> <br />Council authorized City Manager Noland to execute such a contract (or lease <br /> <br />agreement) pursuant to the following resolution: <br /> <br />WHEREAS, the City of Martinsville, Virginia, has given certain assurances <br />to the Department of Housing and Urban Development, of the United States <br />of America, in connection with the City's application for a Federal Grant <br />under the Urban Mass Transportation Act of 1964; and <br /> <br />WHEREAS, said application has been approved by said Department of Housing <br />and Urban Development and said Federal Grant has been assured, for the <br />purchase of seven (7) new busses, which approval and grant are conditioned <br />upon the fact that the assurances made by the City of Martinsville in its <br />application and the covenants of the City of Martinsville--as set out in <br />the capital grant contract--would be binding upon any lessee or contractor <br />of the City of Martinsville; and <br /> <br />WHEREAS, said City of Martinsville desires to enter into a contract or <br />lease agreement with City Transit Company, Inc., as lessee, whereby said <br />City Transit Company, Inc., will lease from the City of Martinsville said <br />seven new busses to be used by lessee in the operation of a local public <br />bus transportation system; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this fourteenth day of February, 1967, that <br />Thomas B. Noland, its City Manager, be and is hereby authorized to execute <br />such a lease agreement with City Transit Company, Inc., which lease <br />agreement shall be for a term of ten years from date of execution thereof <br />and shall make binding upon said City Transit Company, Inc., the assurances <br />and covenants guaranteed by the City of Martinsville. <br /> <br />Council also authorized execution of a supplementary agreement with City Transit <br /> <br />Company, Inc., providing for the City's taking title to two old busses--from <br /> <br />Rapid Transit Company, present operator--to be held in reserve for use by City <br /> <br />Transit Company as lessee. <br /> <br />Upon recommendation by (and resolution of) the Martinsville City School Board, <br /> <br />Council agreed to consider enacting a compulsory school attendance law <br /> <br />applicable to local school students, generally within the seven-to-sixteen <br /> <br />age gro up . <br />
