<br />) \ ~ ') <br />-J <br /> <br />TUESDAY <br /> <br />AUGUST 22, 1972 <br /> <br />In connection with the Planning Commission's recommendation dated July 24, <br /> <br />1972, Council conducted a duly-advertised public hearing on a proposal to <br /> <br />withdraw and cancel a Special-Use Permit issued under date of May 24, 1966 <br /> <br />to Virginia Landmark Corporation to allow construction of an apartment complex <br /> <br />on a 9.66-acre tract of land situated on the north side of Spruce Street <br /> <br />opposite its intersections with Auburn Place and Prospect Hill Drive, <br /> <br />inasmuch as said Virginia Landmark Corporation has never exercised said <br /> <br />Permit. There being no objections registered by anyone against this proposal, <br /> <br />and in acceptance of the Commission's recommendation, Council directed that <br /> <br />said Permit be and is hereby withdrawn and cancelled. <br /> <br />In a companion action, Council conducted a duly-advertised public hearing <br /> <br />on application for a Special-Use Permit filed with Council on April <br /> <br />25, 1972, by Community Methods, Inc., Virginia Beach, Virginia (Mr. Horace <br /> <br />E. Henderson, Chairman of the Board) whereby, if approved as recommended <br /> <br />under date of July 24, 1972 by the Planning Commission, applicant will be <br /> <br />permitted to construct an apartment complex (consisting of 154 units) on <br /> <br />a 9.66-acre tract of land situated on the north side of Spruce Street <br /> <br />opposite its intersections with Auburn Place and Prospect Hill Drive, this <br /> <br />being the same site for which a similar permit was issued to Virginia <br /> <br />Landmark Corporation (May 24, 1966), which permit was withdrawn and cancelled <br /> <br />by Council's action set forth in immediate preceding paragraph. There being <br /> <br />no objections registered by anyone against this proposal, Council accepted <br /> <br />the Commission's recommendations thereon and authorized the issuance of said <br /> <br />Permit to Community Methods, conditioned upon fulfilling the requirements <br /> <br />made a part of the Commission's July 24th recommendation and its supplemental <br /> <br />recommendation that the life of said Permit will be limited to eighteen <br /> <br />months, i.e., development and construction of the project must be underway <br /> <br />within eighteen months from August 22, 1972. <br />
