<br />2( <br /> <br />TUESDAY <br /> <br />SEPTEMBER 28, 1971 <br /> <br />home site rezoned August l7, 1971, stated that the Planning Commission, in <br /> <br />considering and acting favorably upon the site rezoning petition, recognized <br /> <br />the need for such additional facilities proposed by Waldron & Fralin and, <br /> <br />consequently, City Council--when it accepted the Commission's recommendations <br /> <br />that the property be rezoned--at that time apparently recognized the need <br /> <br />and, therefore, should proceed forthwith by endorsing the Waldron and Fralin <br /> <br />project and should accede to petitioner's request. (Note by Council Clerk _ <br /> <br />,- <br /> <br />for Planning Commission's report on foregoing matter, see Minute Book No. 19, <br /> <br />pages 234 and 235~ <br /> <br />With reference to petition filed with Council on June 9, 1970, by the Three T <br /> <br />Investment Corporation, requesting the closing and vacating of a portion of <br /> <br />Middle Street, and with reference to subsequent consideration by Council of <br /> <br />said petition, and after discussing with petitioner and developer alternate <br /> <br />access routes and their advantages and/or disadvantages, Council adopted--with <br /> <br />Councilman Hobson voting against the motion--the following ordinance directing <br /> <br />the closing and vacating of that section of Middle Street as is situated between <br /> <br />Pony Place and the rear lot line of Lot No. 9l and, furthermore, Council <br /> <br />authorized acceptance of deeds to the two parcels of land referred to in said <br /> <br />ordinance, recognizing that actual access to Route 57 is contingent upon future <br /> <br />acquisition of certain property from the Wray Park Corporation: <br /> <br />WHEREAS, by petition filed with Martinsville City Council on June 9, 1970, <br />the Three T Investment Corporation requested the closing and vacating of <br />that section of Middle Street as is situated between Pony Place and the <br />rear lot line of Lot No. 9l, as shown on "Plat of Survey" prepared for <br />petitioner by J. A. Gustin & Associates under date of September 27, 1971, <br />which petition included agreement by petitioner to deed to the City of <br />Martinsville a section of land adjacent to said rear lot line for a <br />turn-aroung area, and to which agreement petitioner subsequently has <br />indicated intent to dedicate to the City of Martinsville portions of Lots <br />Nos. 80 and 81 of the Wray Estates Subdivision for part of Public Access <br />from Pony Place to Virginia Primary Route 57, as shown on Plat of Survey <br />prepared for petitioner by J. A. Gustin & Associates under date of <br />September 24, 1971; and <br />
