<br />~H <br />() . <br /> <br />TUESDAY <br /> <br />SEPTEMBER 2l, 1971 <br /> <br />City Manager Noland, pursuant to City Charter requirements, announced the <br /> <br />appointing of Mr. Jesse W. Williams as Chief of Police for the City of <br /> <br />Martinsville, to take office October l, 1971. Council extended to Mr. and <br /> <br />Mrs. Williams, who were present at this meeting, a warm welcome to Martinsville. <br /> <br />City Manager Noland, by memorandum dated September 3, 1971, informed Council <br /> <br />of some of the rules and conditions under which the City's law enforcement <br /> <br />personnel might qualify for early retirement benefits similar to those now <br /> <br />afforded Virginia State Police personnel, recommending adoption of such a plan <br /> <br />as of January l, 1972. Council indicated concurrence with the Manager's <br /> <br />recommendations; however, it directed that additional information (such as cost <br /> <br />liability upon the City) be obtained and that this matter be placed on Council's <br /> <br />September 28th meeting agenda. <br /> <br />Upon recommendation of City Attorney Cubine, stemming from his opinion that <br /> <br />Section ll-40 as presently written in the 1971 City Code is unconstitutional, <br /> <br />Council reenacted said Section ll-40 by adopting the following ordinance <br /> <br />amending, and to the extent thereof, said 1971 City Code: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this 2lst day of September, 1971, that <br />Section 11-40 of the Code of the City of Martinsville (197l) be--and <br />is hereby--amended by the following reenactment of said Section ll-40: <br /> <br />Sec. 11-40. Same--Failure to leave school premises when directed <br />by duly authorized person to do so. <br /> <br />Should any person, whether or not a student, when upon the premises <br />of any school or within or upon the buildings and grounds of any <br />school or within or upon any gymnasium, stadiums, fields or parks at <br />which school functions and/or games are conducted, conduct himself in <br />such a manner as to create a disturbance or become a nuisance or be a <br />menace to life, limb, or property, or disrupt traffic or pedestrian <br />travel, or conduct himself in a manner not conducive to orderly <br />attendance; or disrupt orderly functions of such school, game or <br />event, such person shall be guilty of a misdemeanor if he fail to <br />
