<br />l' <br /> <br />TUESDAY <br /> <br />JANUARY 12, 1971 <br /> <br />,"~- <br /> <br />In connection with a petition dated September 25, 1970, filed by Mrs. Evelyn H. <br /> <br />Stone, Trustee, requesting the rezoning to IIR-9 Residential" of a 78-acre tract <br /> <br />of land lying between Rives Road Extended and the right-of-way of the Norfolk & <br /> <br />Western Railway Company, Council acknowledged receipt of the following report <br /> <br />thereon of the Planning Commission, which recommended denial of the petition, <br /> <br />and, also, called for a duly-advertised public hearing thereon to be conducted <br /> <br />by Council at its forthcoming February 9th meeting: <br /> <br />The Planning Commission conducted a public hearing on December 1, 1970, <br />on a petition submitted by Evelyn H. Stone, Trustee, requesting the <br />rezoning of approximately 78 acres, lying between Rives Road Extension <br />and the N. & W. railroad from its present M-3 Industrial to an R-9 <br />Residential classification. <br /> <br />Further consideration was given this matter by the Commission at its <br />meeting on January 5, 1971. Following this consideration, the Commission <br />voted to recommend to Council that this petition be denied. <br /> <br />In reaching the above decision the Commission gave consideration to the <br />following facts: <br /> <br />1. That this property lies adjacent to an existing industrial access <br />road which was built partially to serve this property. <br /> <br />2. That the Industrial Park lying outside the City is taxing the City's <br />water system at the present time and consideration must be given to <br />industrial sites inside the City to justify the expenditure necessary <br />to serve industrial sites with City utilities and roads. <br /> <br />3. All criteria for industrial development are met on this site; i.e., <br />industrial access road adjacent to property; railroad adjacent to <br />property and all utilities are available at this site. <br /> <br />The Planning Commission respectfully submits the above recommendation for <br />Council's further consideration. <br /> <br />In tentative acceptance of the Planning Commission's recommendations, relating <br /> <br />to Piedmont Masonic Lodge's October 6th (1970) petition requesting the rezoning <br /> <br />of its properties--to "C-2"--fronting the west side of Starling Avenue, between <br /> <br />Spring and Wilson Streets,.which recommendations were: <br /> <br />(1) That the City's <br /> <br />Zoning Ordinance be amended in accordance with suggested amendments presented <br /> <br />and (2) that all properties fronting the west side of Starling Avenue be rezoned <br />
