ro TUESDAY JANUARY 12, 1971 Pursuant to duly-advertised public notice, Council conducted a public hearing on Mrs. James M. Stone's October 13th (1970) petition requesting the closing and vacating of that portion of IICII Street which lies between 411 Fifth Street and 524 Fourth Street. Having received favorable reports on said petition from both the Planning Commission and a duly-constituted Board of Viewers, and there being no objections registered by anyone, Council effected said closing by its unanimous adoption of the following ordinance, which includes certain stipulations and conditions recommended by the Planning Commission: WHEREAS, by petition filed October 13, 1970 with Martinsville City Council, Mrs. James M. Stone (residing at 411 Fifth Street) requested the closing and vacating of that portion of llCII Street which lies between 411 Fifth Street and 524 Fourth Street; and WHEREAS, under date of December 22, 1970, a duly-constituted Board of Viewers reported that, in its opinion, no inconvenience would result to anyone by the closing and vacating of said street portion; and WHEREAS, under date of December 4, 1970, the Martinsville Planning Commission recommended that petition be granted, subject to retention by the City of the usual utility easements through the right-of-way of said street portion and subject to the preparation of a proper map in recordable form indicating the effect of the closing upon adjacent properties; and WHEREAS, at its regular meeting held January 12, 1971, Martinsville City Council conducted a duly-advertised public hearing on said proposal, at which meeting no one registered any objection thereto said proposal; now, therefore, BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular meeting assembled this twelfth day of January, 1971, that it doth accept the findings and recommendations of both the said Board of Viewers and the said Planning Commission; and BE IT FURTHER ORDAINED by said Council that said section or portion of IIC" Street be, and is hereby, declared vacated, closed and abandoned, subject to (1) the retention by the City of Martinsville of the usual utility easements through the right-of-way of the section hereby closed and (2) the preparation of a proper map in recordable form indicating the effect of this closing on the adjacent properties; and BE IT FURTHER ORDAINED that a copy of this ordinance be forthwith filed with the Clerk of Martinsville Corporation Court, as authorization to mark his records accordingly.
