<br />ro <br /> <br />TUESDAY <br /> <br />JANUARY 12, 1971 <br /> <br />Pursuant to duly-advertised public notice, Council conducted a public hearing <br /> <br />on Mrs. James M. Stone's October 13th (1970) petition requesting the closing <br /> <br />and vacating of that portion of IICII Street which lies between 411 Fifth Street <br /> <br />and 524 Fourth Street. Having received favorable reports on said petition <br /> <br />from both the Planning Commission and a duly-constituted Board of Viewers, and <br /> <br />there being no objections registered by anyone, Council effected said closing <br /> <br />by its unanimous adoption of the following ordinance, which includes certain <br /> <br />stipulations and conditions recommended by the Planning Commission: <br /> <br />WHEREAS, by petition filed October 13, 1970 with Martinsville City <br />Council, Mrs. James M. Stone (residing at 411 Fifth Street) requested <br />the closing and vacating of that portion of llCII Street which lies <br />between 411 Fifth Street and 524 Fourth Street; and <br /> <br />WHEREAS, under date of December 22, 1970, a duly-constituted Board of <br />Viewers reported that, in its opinion, no inconvenience would result <br />to anyone by the closing and vacating of said street portion; and <br /> <br />WHEREAS, under date of December 4, 1970, the Martinsville Planning <br />Commission recommended that petition be granted, subject to retention <br />by the City of the usual utility easements through the right-of-way <br />of said street portion and subject to the preparation of a proper <br />map in recordable form indicating the effect of the closing upon <br />adjacent properties; and <br /> <br />WHEREAS, at its regular meeting held January 12, 1971, Martinsville City <br />Council conducted a duly-advertised public hearing on said proposal, at <br />which meeting no one registered any objection thereto said proposal; now, <br />therefore, <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this twelfth day of January, 1971, that it <br />doth accept the findings and recommendations of both the said Board of <br />Viewers and the said Planning Commission; and <br /> <br />BE IT FURTHER ORDAINED by said Council that said section or portion of <br />IIC" Street be, and is hereby, declared vacated, closed and abandoned, <br />subject to (1) the retention by the City of Martinsville of the usual <br />utility easements through the right-of-way of the section hereby closed <br />and (2) the preparation of a proper map in recordable form indicating <br />the effect of this closing on the adjacent properties; and <br /> <br />BE IT FURTHER ORDAINED that a copy of this ordinance be forthwith filed <br />with the Clerk of Martinsville Corporation Court, as authorization to <br />mark his records accordingly. <br />
