<br />r'o <br />l) <br /> <br />TUESDAY <br /> <br />OCTOBER l3, 1970 <br /> <br />Section Nine of the above contract, however, waived the require- <br />ments of the City's Water and Sewer Ordinances, pertaining to the <br />construction of sewer lines to serve the lots abutting the street <br />because of the estimated cost that would be incurred by the developer <br />in extending a line from the City's sewage system to the street in <br />question. <br /> <br />We were of the op~n~on during the contract negotiations with the <br />City, that septic tanks would be permitted by the Health Department <br />to serve the individual lots within our subdivision. Apparently, the <br />position of the Health Department changed during the construction of <br />this street, and it now appears that the Health Department will not <br />issue permits for septic tanks to serve this area. Two thousand feet <br />of trunk line, plus approximately 500 feet of collector sewer line <br />will be needed to provide sewer service for the eight (8) lots fronting <br />this street. <br /> <br />Our subdivision is contiguous to the City and is situated on the <br />Mulberry Creek Drainage Basin. A number of years ago, the City installed <br />the Mulberry Creek Outfall line which was designed to serve the entire <br />Mulberry Creek Drainage Basin to which our property should logically <br />drain. We believe that all of the property situated within the <br />Mulberry Creek Basin should be served by the City's sewage system, and <br />we are willing to pay for the extension of a line within our property <br />service to the lots which we are developing. However, it is necessary <br />that a trunk line be extended through other property in order to pro- <br />vide service to lots that we are developing. If the total cost of the <br />lines on our property, plus the line that would pass through other <br />property would have to be borne by us, this extension would be <br />impossible because of the limited number of lots owned by us to which <br />the cost of this line would have to be apportioned. <br /> <br />In view of the fact that our property should logically be served <br />by the City's system, and in consideration of the fact that a trunk <br />line to serve our property would pass through other property that no <br />doubt will be developed in the future, we ask that the City give <br />consideration to the adoption of a policy whereby a trunk line could <br />be extended to our property line from which point we would extend a <br />sewer collector line to the extent necessary to provide sewer service <br />for our property in accordance with City standards and specifications. <br />At such time that other property is developed through which the trunk <br />line not situated on our property passes, a charge could be made to the <br />subdivider as connections are made to the trunk line, whereby the City <br />could recover all of the cost incurred in extending this line. We <br />would estimate the cost to us of constructing the collector line within <br />our property to be $4,650.00, and the cost of the trunk line which <br />would be borne by others is $9,350.00. <br /> <br />As you are aware, there is considerable property situated adjacent <br />to the City on the Mulberry Creek Drainage Basin, which will probably <br />be developed in the foreseeable future. We feel that whether this <br />property remains in the County or is annexed to the City, since the <br />City has an outfall line along Mulberry Creek of adequate size to serve <br />
