<br />-iU <br /> <br />TUESDAY <br /> <br />OCTOBER 13, 1970 <br /> <br />WHEREAS, the Virginia Department of Highways proposes to construct or <br />otherwise improve a section of roadway from the intersection of West <br />Church Street to the intersection of Route 57, within the corporate <br />limits of the City of Martinsville, Virginia, as Highway Project No. <br />0057-120-103, C-50l; and, <br /> <br />WHEREAS, the City of Martinsville is responsible for making arrangements <br />for the adjustment and/or relocation of certain utilities and for the <br />installation of any new facilities required; now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, <br />in regular meeting assembled this thirteenth day of October, 1970, that <br />it hereby certifies that all arrangements have been made or will be <br />made for the relocation and/or adjustment of said utility facilities <br />and for the installation of any new facilities required; and <br /> <br />BE IT FURTHER RESOLVED by said Council that, in the event of any <br />justifiable claims from the road contractor for delays or interference <br />caused by said utilities, the City of Martinsville hereby agrees to be <br />responsible for said claims, provided it may legally do so and, further, <br />provided the City is advised in writing by the Virginia Department of <br />Highways at the time of delay that the road contractor intends to file <br />a claim. <br /> <br />Said utilities are identified as follows: <br /> <br />UTILITY OWNER <br /> <br />TYPE OF FACILITY <br /> <br />Appalachian Power Company <br />Lee Telephone Company <br />City of Martinsville <br /> <br />Electric Power <br />Telephone <br />Electric, Water & Sanitary Sewer <br /> <br />Upon motion, duly seconded and unanimously carried, Council granted permission <br /> <br />to the Norfolk & Western Railway Company to extend a "team" tract over City- <br /> <br />owned property (involving a fifteen-foot easement) for a distance of <br /> <br />approximately one hundred feet, with a fifty-foot turn-around, all within the <br /> <br />City's Industrial Park and near the intersection of the Industrial Park Access <br /> <br />Road and Route 220 South. It was noted that this extension is necessary in <br /> <br />order that the railway company may serve the new Lowe's Hardware building, <br /> <br />now under construction; however, it was also noted that the extension may be <br /> <br />only temporary or may require relocating of same in the future. <br /> <br />."'...._o<_n_____._._____-.'M.........--'.-......-. <br />
