<br />lL <br /> <br />TUESDAY <br /> <br />OCTOBER l3, 1970 <br /> <br />..-" <br /> <br />(2) Lots Nos. 60 through 78 shall retain their present <br />residential zoning for a depth of fifty (50) feet from <br />their Forest Street property lines; and <br /> <br />(3) Nationwide Homes, and/or any successor thereto, shall <br />install and maintain trscreen planting" in the old right- <br />of-way of Forest Street immediately below Childress Drive <br />sufficient to shield the industrial plant site from <br />casual view. <br /> <br />.-' <br /> <br />Upon request of the Virginia Department of Highways, Council authorized City <br /> <br />Manager Noland to execute--on behalf of the City--an agreement involving the <br /> <br />City, the Department of Highways, and the Carolina & Northwestern Railway <br /> <br />Company and providing for the construction of a bridge over the railway company's <br /> <br />right-of-way at its Milepost No. 43.7, said construction being a part of the <br /> <br />current Route 57 highway construction and relocation project. <br /> <br />Also, in connection with said highway project, the Department of Highways <br /> <br />informed Council (by letter dated September 25, 1970) that the City of <br /> <br />Martinsville is responsible for making arrangements for the adjustment and/or <br /> <br />relocation of certain utilities and for the installation of any new facilities, <br /> <br />guaranteeing assumption of this responsibility through the adopting of a <br /> <br />formal resolution, including responsibility for any justifiable claims from <br /> <br />the prime contractor for delays and interferences caused by said utilities. <br /> <br />Inasmuch as said utilities are identified as not only the City of Martinsville <br /> <br />but also the Appalachian Power Company and the Lee Telephone Company, Council <br /> <br />authorized formal inclusion of said resolution in the minutes of this meeting, <br /> <br />indicating adoption thereof, only if it is ascertained by City Attorney Cubine <br /> <br />that either the City is protected through its franchises granted Appalachian <br /> <br />Power Company and Lee Telephone Company or is protected through supplementary <br /> <br />agreement(s) with the~public utilities.
