<br />fj <br /> <br />TUESDAY <br /> <br />FEBRUARY 10, 1970 <br /> <br />~ <br /> <br />Council was informed that the State Corporation Commission recently has issued <br /> <br />a ruling favorable to the cities and counties of Virginia, sustaining the <br /> <br />Commission's assessment of railway properties (in Virginia) for local taxation <br /> <br />for the year 1968, a protest against which the railway companies filed notices <br /> <br />thereof with the Commission under date of November 13, 1968, including the right <br /> <br />to recover alleged excess taxes paid to local governments. Council was further <br /> <br />informed that the railway companies have appealed this ruling to the Virginia <br /> <br />Supreme Court of Appeals and that the representation before the Commission should <br /> <br />be retained before the Virginia Supreme Court, for which Martinsville's proportionate <br /> <br />cost would be $76.00; whereupon Council unanimously authorized such continued <br /> <br />representation and agreed to pay said proportionate cost. <br /> <br />- <br /> <br />Upon motion, duly seconded and unanimously carried, Council adopted an ordinance <br /> <br />imposing a license tax upon motor vehicles for the year beginning March 15, 1970, <br /> <br />being a re-enactment of similar ordinance for the year which began March 15, 1969. <br /> <br />Council referred to the Planning Commission, for its consideration and <br /> <br />recommendation, a petition received from Mrs. Bertha Marshall, requesting the <br /> <br />rezoning of her property at 210 South Moss Street from "R-6" to "P-2". <br /> <br />- <br /> <br />Council approved a request, dated February 4, 1970, from Mr. Clifford L. Minter <br /> <br />that he be allowed--at no expense to the City--to extend a City water main from <br /> <br />its present terminus on Chatham Road, outside the City's corporate limits, for a <br /> <br />distance of approximately 123 feet to provide City water service to his residence, <br /> <br />also outside the corporate limits, contingent upon the preparation and executing <br /> <br />of an agreement or contract between the City and Mr. Minter, consistent with the <br /> <br />City's regulations governing such extensions. <br />
