1- THURSDAY DECEMBER 18, 1969 December 18, 1969, at which meeting no one to the proposed closing of said portion of therefore, registered an objections said unopened street; now, BE IT ORDAINED by the Council of the City of Martinsville, Virginia, in regular meeting assembled this eighteenth day of December, 1969, that-- in acceptance of the reports and findings of both the Martinsville Planning Commission and said Board of Viewers--it doth hereby order the vacating and abandoning of that portion of an unopened street, off Boden Street, which lies between Lots Nos. 27, 28, 30, and 31 owned by petitioner; and BE IT FURTHER ORDAINED that a copy of this ordinance be forthwith filed with the Clerk of the Corporation Court of the City of Martinsville, Virginia, as authorization for said Clerk to mark his records according hereto. After considering further the rate application petition recently filed by Southwestern Virginia Gas Company with the State Corporation Commission, Council discussed--"off the record"--certain privileged information obtained by City Manager Noland and City Attorney Cubine, at the conclusion of which discussion Council expressed the conviction that the amount or high percentage of rate increases sought by petitioner are not justified and that, in the interest of local citizens, the petition should be opposed with expert testimony before the Corporation Commission at its scheduled hearing on this matter on January 5, 1970; whereupon, Council authorized the retaining of the legal firm of Christian, Barton, Parker, Epps & Brent, of Richmond, Virginia, pursuant to recommendation of City Attorney Cubine, to represent the City of Martinsville and its citizens before the Corporation Commission.
