<br />~ <br /> <br />.- <br /> <br />-..._......__._-~-.-,..._----_. -- ----------.-.-----.-.--..- <br /> <br />t. <br /> <br />THURSDAY <br /> <br />DECEMBER 18, 1969 <br /> <br />and the Planning Commission having recommended that petitioner's amended <br /> <br />request be granted, Council adopted the following ordinance amending the <br /> <br />City's Zoning Code and Map, effecting said rezoning: <br /> <br />BE IT ORDAINED by the Council of the City of Martinsville, <br />Virginia, in regular meeting assembled this eighteenth day of <br />December, 1969, that the Zoning Ordinance and the Zoning Map <br />of the City of Martinsville be--and are hereby--amended to <br />reclassify to "C-3 Commercial" the following lots owned by <br />G. C. Y., Inc., and located in the area of the former Club <br />Martinique building, off the south side of East Church Street <br />(Route 58 East, in Martinsville, Virginia), viz., Nos. 25, 26, <br />27, 28, 30, 31, 32, and 33. <br /> <br />Also, pursuant to duly-advertised public notice, Council conducted a public <br /> <br />hearing on the petition of G. C. Y., Inc., requesting the vacating and <br /> <br />abandoning of a portion of an unopened street in the Boden Street area. <br /> <br />There being no objections registered to the closing of the portion of the <br /> <br />unopened street, and the Planning Commission having so recommended, and a <br /> <br />duly-constituted Board of Viewers having reported in writing that--in its <br /> <br />opinion, after having viewed the street and surrounding properties--no <br /> <br />inconveniences would result to anyone by the closing of said street portion, <br /> <br />Council effected said closing by the unanimous adoption of the following <br /> <br />ordinance: <br /> <br />WHEREAS, by petition dated October 13, 1969 and filed with Martinsville <br />City Council on October 14, 1969, the firm of G. C. Y., Inc., requested <br />the closing and abandoning of a twenty-foot unopened street off Boden <br />Street, in East Martinsville; and, <br /> <br />WHEREAS, under date of November 21, 1969, the Martinsville Planning <br />Commission, having duly considered said petition (as originally filed <br />and as subsequently amended by petitioner) and having conducted a <br />duly-advertised public hearing on said request (as amended), recommended <br />that the amended request be granted; and <br /> <br />WHEREAS, under date of December 15, 1969, a duly-constituted Board of <br />Viewers reported that, in its opinion, no inconvenience would result to <br />anyone by the discontinuance and abandonment of the portion of said <br />unopened street; and <br /> <br />WHEREAS, Martinsville City Council conducted a duly-advertised public <br />hearing on said petition, as amended, at its regular meeting held <br />
