<br />] <br /> <br />TUESDAY <br /> <br />OCTOBER 14, 1969 <br /> <br />.,~- <br /> <br />A RESOLUTION AUTHORIZING THE CITY ATTORNEY FOR THE CITY OF MARTINSVILLE TO <br />INSTITUTE CONDEMNATION PROCEEDINGS TO ACQUIRE EASEMENT AND/OR RIGHT-OF-WAY <br />FOR PROPOSED AND NECESSARY SEWER LINE OVER LANDS OWNED BY WRAY PARK CORPORATION <br /> <br />WHEREAS, the agent and right-of-way negotiator for the City of Martinsvil1e's <br />sewerage system improvement program has informed the Council of the City of <br />Martinsvil1e that he has exhausted all available means within the limitations <br />of his authority, and without success, to acquire perpetual easement and/or <br />right-of-way from Wray Park Corporation for a sanitary sewer extending some <br />forty-seven (47) feet across the property of said Wray Park Corporation, <br />which easement and/or right-of-way are necessary to the constructing of a <br />sanitary sewer line identified as "Line 6-12A" (as shown on plans prepared <br />by the City of Martinsvi1le's Engineering Division under date of April 10, <br />1969), and which property is that deeded to Wray Park Corporation from W. B. <br />Muse, Jr., and Evelyn Muse, his wife, of record in Deed Book 44, Page 70, <br />dated April 28, 1956, in the Henry County Circuit Court Clerk's Office, said <br />property being south of Virginia Primary Route #57, now, therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in <br />regular meeting assembled this fourteenth day of October, 1969, that Irvin <br />W. Cubine, its City Attorney and an attorney at law, be and is hereby <br />authorized to institute condemnation proceedings to acquire said easement <br />and/or right-of-way and, as the City's attorney, to make oath to the petition, <br />all in accord with the statutes of the Commonwealth of Virginia and the <br />prov~s~ons of the Charter of the City of Martinsville, Virginia, in such <br />cases made and provided. <br /> <br />In acknowledging receipt of the documents entitled "Martinsville Thoroughfare Plan <br /> <br />(1969)" and "Martinsville Functional Plan (1969)11 from the Virginia Department of <br /> <br />Highways, Council expressed appreciation to the Highway Department for its perfor- <br /> <br />mance of this service to the City and for its expeditious handling of Council's <br /> <br />request for this service. <br /> <br />In tentative acceptance of the Planning Commission's recommendation thereon, Council <br /> <br />called for a public hearing--to be conducted at Council's forthcoming November 11th <br /> <br />meeting--on The Lester Corporation's application for a Special-Use Permit to allow <br /> <br />petitioner to construct an additional apartment building on property adjacent to <br /> <br />petitioner's present apartment building site at the corner of Corn Tassel Trail <br /> <br />and Spruce Street (Extension), pursuant to the Unified Housing Development section <br /> <br />of the City's Zoning Ordinance. <br />
