<br />o <br /> <br />TUESDAY <br /> <br />OCTOBER 14, 1969 <br /> <br />Council also referred to the Planning Commission, for its consideration and <br /> <br />recommendation, a petition filed by Lanier Farm, Inc., requesting rhe rezoning <br /> <br />to "P_2" of its property on the south side of Spruce Street, between Indian <br /> <br />Trail and the rear property lines of lots on the west side of Windsor Lane. <br /> <br />Public Works Director George W. Brown informed Council that the residents and <br /> <br />property owners of Oakwood Court have recently notified the City that they desire <br /> <br />to have curb-and-gutter constructed on this street, in accordance with the City's <br /> <br />shared-cost program, thus reactivating their petition filed some years ago which, <br /> <br />heretofore, has lacked the shared-cost participation required. Mr. Brown also <br /> <br />informed Council that the property owners of the far segment of Mulberry Road <br /> <br />now wish to have this segment (between Mulberry Court and the property of Forest <br /> <br />Park Country Club) included in the curb-and-gutter project as initially approved <br /> <br />for the current year. Council directed that the Oakwood Court petition be <br /> <br />included for review for the 1970-71 program and that the Mulberry Road segment be <br /> <br />placed on the construction schedule for scheduling on a "when can" basis, keeping <br /> <br />in mind the priority assigned to the Swanson Street petition and the conditions <br /> <br />attached thereto, as referred to in Council's minutes of August 26, 1969. <br /> <br />Pending receipt of a letter (in transit) from the Wray Park Corporation, in reply <br /> <br />to the City's recent offer to purchase required right-of-way and/or easement from <br /> <br />the Corporation for a necessary sewer line to serve the Three-T Corporation, and <br /> <br />with authorization to acquire said right-of-way and/or easement in the manner <br /> <br />hereinafter set forth, if negotiations now in process are unsuccessful, Council <br /> <br />adopted the following re~lttion authorizing the City Attorney to institute <br /> <br />condemnation proceedings toward the acquisition of said easement and/or right-of-way: <br />
