<br />34 <br /> <br />TUESDAY <br /> <br />DECEMBER 10, 1974 <br /> <br />- <br /> <br />authorized, the cost of which is estimated to be between $7,500.00 and $10,000.00; <br /> <br />whereupon, Council unanimously authorized this additional study, within the estimated <br /> <br />cost limits, to be financed from Revenue-Sharing funds available to the Commission. <br /> <br />In connection with the anticipated filing of an application with the Federal Government <br /> <br />and the State Water Control Board for funds to help finance the upgrading of the City's <br /> <br />sewage treatment plant (water pollution control facility), Council unanimously adopted <br /> <br />the following resolution in which the City of Martinsville stipulates that (1) it will <br /> <br />adopt a sewer use ordinance, (2) it will develop and maintain an industrial cost recovery <br /> <br />system, and (3) will develop and maintain a user charge system, all in accordance with <br /> <br />applicable Federal requirements: <br /> <br />WHEREAS, the Federal Water Pollution Control Act (33 U.S.C. 1251 et seq.) <br />and Federal Water Pollution Control Acts Amendments, Public Law 92-500, <br />were enacted by the Federal Government to restore and maintain the chemical, <br />physical, and biological integrity of the Nation's waters; and, in order to <br />implement this objective, the United States Congress established a regulatory <br />and enforcement strategy and a system of subsidies to localities to permit <br />localities to achieve the goals of the Act; and <br /> <br />WHEREAS, the City of Martinsville, Virginia, as owner and operator of a <br />Water Pollution Control facility, does desire to upgrade its existing <br />primary treatment facility to meet the goals and objectives of P.L. 92-500; <br />and <br /> <br />WHEREAS, the Virginia State Water Control Board, as the appropriate agency, <br />at its regular meeting held in April of 1974, placed the City of Martinsville <br />on its project priority list for Federal and State monies in FY-1975; now, <br />therefore, <br /> <br />BE IT RESOLVED by the Council of the City of Martinsville, Virginia, that a <br />Step-3 (construction project) grant application be filed with said State <br />Water Control Board, pursuant to the necessary requirements of the present <br />Federal laws; and <br /> <br />BE IT FURTHER RESOLVED by said Council that certain of these requirements <br />are hereby stipulated, as follows: <br /> <br />1. The City of Martinsville will adopt a sewer use ordinance or <br />will expand existing sewer use codes pursuant to the requirements <br />of 40 CFR 35.927-4 or related sections. <br />
