<br />'JI · ~ '"" <br />tJ,J0 <br /> <br />TUESDAY <br /> <br />NOVEMBER 26, 1974 <br /> <br />However, it shall be unlawful for any person to maintain, <br />conduct or operate any public dance between the hours of <br />1:00 A.M. and 12 o'clock midnight of any Sunday. <br /> <br />BE IT FURTHER ORDAINED by said Council that this ordinance shall be in <br />effect on and after December 7, 1974. <br /> <br />On the basis of a recent Supreme Court ruling, Council authorized the refunding <br /> <br />of $10,010.45 taxes paid by The First National Bank of Martinsvi1le & Henry <br /> <br />County for the tax years 1971, 1972, and 1973, to said bank, being the taxes <br /> <br />assessed and paid on capital notes and debentures ruled not taxable as "bank <br /> <br />stock" tax, said refund payment to be withheld pending directive from the <br /> <br />State Department of Taxation. <br /> <br />Upon recommendation of Mr. D. B. Hanel, Commissioner of the Revenue, Council <br /> <br />took under advisement a proposal whereby the City's real estate tax year would <br /> <br />be changed from the present calendar year basis to a fiscal year basis, mean- <br /> <br />while directing City Attorney Worthy to prepare an appropriate ordinance--which <br /> <br />would effect said change--for Council's consideration. <br /> <br />Ratifying its action taken December 11, 1973 and the subsequent execution of <br /> <br />a contract or agreement by the City's then-Mayor, Francis T. West, concerning <br /> <br />the Lester Street grade crossing of right-of-way of the Carolina & Northwestern <br /> <br />Railway Company, Council unanimously adopted the following resolution: <br /> <br />WHEREAS, at its regular meeting held December 11, 1973, Martinsvi1le City <br />Council approved a contract or agreement with the Southern Railway Company <br />(for the Carolina & Northwestern Railway Company), joined by The First <br />National Bank of Martinsville & Henry County, Trustee (under the will of <br />Cornelia G. Brown) and by American Furniture Company, a Virginia corporation, <br />providing for the extending of Lester Street across said railway company's <br />right-of-way at Milepost 42.3, in Martinsville, Virginia, subject to the <br />re-writing of one paragraph or section of said contract or agreement whereby, <br />when re-written, said railway company--if and when future highway conditions <br />
