C() ,0. TUESDAY APRIL 9, 1974 permitted by the City Charter. The Commission had been in consultation with the City Attorney, who at this point reported that his analysis of the situation lead him to recommend that to get the project under way as soon as possible Council should proceed under the charter provision allowing Council to constitute itself as an authority. After a full discussion of the matter, during which all agreed that this is a very significant development and that the considerable amount of time which the CBD Commission had spent was of vital interest to the City, motion was made by Mr. Lester, seconded by Mr. Hartford and carried unanimously that .the City proceed immediately to begin the purchase of certain downtown properties, as outlined in Phase I of the plans for CBD Redevelopment. Then, on motion made by Vice-Mayor Boaz and seconded by Councilman Hartford, Council unanimously adopted-- by recorded vote (ayes: Messrs. Boaz, Hartford, Hobson, Lester, and West; noes: none)--the following resolution: WHEREAS, paragraph (38) of Section 2, Chapter 1 of the Charter of the City of Martinsville, Virginia, provides that the members of the Council of the City of Martinsville, during their respective terms of office as councilmen, are authorized and empowered to act as the Commissioners of the Martinsville Redevelopment and Housing Authority whenever the said council shall adopt a resolution declaring the need for an authority to function in the City of Martinsville and the determination that the members of the council of the City of Martinsville shall act as the Commissioners of said Authority, and, WHEREAS the said Council has determined that there is a need for an Authority to function in the City of Martinsville and has determined that the members of the Council shall act as Commissioners of the said Authority. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Martinsville, Virginia, in regular session held on April 9, 1974, that there is a need for a Redevelopment and Housing Authority to function in the City of Martinsville, Virginia, and, BE IT FURTHER RESOLVED that the members of the Council of the City of Martinsville, Virginia, shall act as Commissioners of the said Authority in accordance with the provisions of the aforesaid paragraph and in full exercise of the powers, privileges, and duties granted under the provisions of the Housing Authorities Law, Sections 36-l to 36-55.6 of the 1950 Code of Virginia, as amended.
