<br />C() <br />,0. <br /> <br />TUESDAY APRIL 9, 1974 <br /> <br />permitted by the City Charter. The Commission had been in consultation with the <br /> <br />City Attorney, who at this point reported that his analysis of the situation lead <br /> <br />him to recommend that to get the project under way as soon as possible Council <br /> <br />should proceed under the charter provision allowing Council to constitute itself <br /> <br />as an authority. After a full discussion of the matter, during which all agreed <br /> <br />that this is a very significant development and that the considerable amount of <br /> <br />time which the CBD Commission had spent was of vital interest to the City, motion <br /> <br />was made by Mr. Lester, seconded by Mr. Hartford and carried unanimously that <br /> <br />.the City proceed immediately to begin the purchase of certain downtown properties, <br /> <br />as outlined in Phase I of the plans for CBD Redevelopment. Then, on motion made by <br />Vice-Mayor Boaz and seconded by Councilman Hartford, Council unanimously adopted-- <br />by recorded vote (ayes: Messrs. Boaz, Hartford, Hobson, Lester, and West; noes: <br />none)--the following resolution: <br /> <br />WHEREAS, paragraph (38) of Section 2, Chapter 1 of the Charter of the <br />City of Martinsville, Virginia, provides that the members of the Council <br />of the City of Martinsville, during their respective terms of office as <br />councilmen, are authorized and empowered to act as the Commissioners of <br />the Martinsville Redevelopment and Housing Authority whenever the said <br />council shall adopt a resolution declaring the need for an authority to <br />function in the City of Martinsville and the determination that the <br />members of the council of the City of Martinsville shall act as the <br />Commissioners of said Authority, and, <br /> <br />WHEREAS the said Council has determined that there is a need for an <br />Authority to function in the City of Martinsville and has determined <br />that the members of the Council shall act as Commissioners of the said <br />Authority. <br /> <br />NOW THEREFORE, BE IT RESOLVED by the Council of the City of Martinsville, <br />Virginia, in regular session held on April 9, 1974, that there is a need for <br />a Redevelopment and Housing Authority to function in the City of Martinsville, <br />Virginia, and, <br /> <br />BE IT FURTHER RESOLVED that the members of the Council of the City of <br />Martinsville, Virginia, shall act as Commissioners of the said Authority <br />in accordance with the provisions of the aforesaid paragraph and in full <br />exercise of the powers, privileges, and duties granted under the provisions <br />of the Housing Authorities Law, Sections 36-l to 36-55.6 of the 1950 <br />Code of Virginia, as amended. <br />
