<br />22J <br /> <br />TUESDAY <br /> <br />JANUARY 22, 1974 <br /> <br />both County and City, who had been so deeply involved in the lengthy and complicated negotiations, <br /> <br />after which the meeting was adjourned at 9:00 P. M. <br /> <br />THIS CONTRACT, made and entered into this the 22nd day of January, Nineteen Hundred <br />Seventy-Four, by and between the CITY OF MARTINSVILLE, party of the first part and <br />hereinafter referred to as the "City"; and the HENRY COUNTY PUBLIC SERVICE AUTHORITY, <br />party of the second part, and hereinafter referred to as the "Authority"; (both parties <br />being political subdivisions of the Commonwealth of Virginia); <br /> <br />WIT N E SSE T H: <br /> <br />WHEREAS, the City owns and operates within and without the City of Martinsville a <br />sewage treatment plant facility with a system of interceptors leading therefrom to <br />portions of the City's corporate limits and, at places, to points beyond said corporate <br />limits, which said plant and system is capable of treating wastes which otherwise and <br />at times heretofore have been discharged into the waters of Smith River and its <br />tributaries; and <br /> <br />WHEREAS, the City is agreeable that its said treatment plant and system of interceptors <br />serve as a regional facility and is willing to obligate itself by equitable contract, <br />entered into with the Authority to accept, transport and treat certain of the sewage and <br />wastes originating in areas outside said City's corporate limits; and <br /> <br />WHEREAS, while the capacity of the City's sewer system and its sewage treatment plant <br />were respectively designed and constructed, at the City's expense, to transport and to <br />treat all normal wastes anticipated to originate, for a long period of years, not only <br />in the combined areas from which the City is presently receiving and treating such <br />wastes, but, also, in other areas in the vicinity of the City, it may become necessary <br />from time to time, to enlarge or extend said facilities or to upgrade, change or improve <br />upon or increase the degree or method of treatment of said wastes; and <br /> <br />WHEREAS, the Authority desires that the City receive the normal wastes originating <br />within the AREA hereinafter defined and transport the same to, and treat such wastes <br />at, its sewage treatment plant, to the end that no untreated or improperly treated <br />wastes from said AREA be discharged into the streams, or elsewhere within said AREA; and <br /> <br />WHEREAS, City Council, during a special called meeting held October 30, 1973, <br />authorized the entering into a contractual agreement with the Henry County, Virginia, <br />Public Service Authority setting forth conditions under which the City would receive <br />and treat sewage from the AREA; and <br /> <br />WHEREAS, a policy of the Virginia State Water Control Board requires that satisfactory <br />interjurisdictional agreements be entered into by the various political subdivisions <br />involved in regional sewerage system improvements in order to receive State and Federal <br />funds for such facilities; and <br /> <br />WHEREAS, the parties to this contract are interested in the orderly development of <br />property situated within the AREA; <br />
