<br />221") <br />,,J~ <br /> <br />TUESDAY <br /> <br />JANUARY 22, 1974 <br /> <br />THEREFORE, FOR AND IN CONSIDERATION of the premises and of the covenants and <br />obligations herein contained, the parties hereto covenant and agree, one with the <br />other as follows: <br /> <br />I. DEFINITIONS: <br /> <br />The parties hereto agree that the following words, terms, and abbreviations as <br />used in this contract shall have the following defined meanings: <br /> <br />A. AREA: <br /> <br />That area of Henry County proposed to be served by the Martinsville <br />Regional Sewage Disposal Facilities, designated as a part of the <br />"Ultimate Service Area" on attached Exhibit 1, identified as Plate 18, <br />titled "Incremental Service Areas and Sewerage Facilities for Smith <br />River," of the Metropolitan Regional Comprehensive Water and Wastewater <br />Disposal Plan adopted by the West Piedmont Planning District Commission <br />and dated September 10, 1973; or as may be amended and revised from time <br />to time by the West Piedmont Planning District Commission. <br /> <br />B. CITY: The City of Martinsville, Virginia. <br /> <br />C. COUNTY: The County of Henry, Virginia. <br /> <br />D. AUTHORITY: Henry County Public Service Authority of Henry County, Virginia. <br /> <br />E. C. O. D. or C. O. D. Content: Chemical Oxygen Demand. <br /> <br />F. B. O. D. or B. O. D. Content: The quantity of oxygen utilized in the <br />biochemical oxidation of organic matter under standard laboratory <br />procedure in five days at 200 C., expressed in parts per million by <br />weight. <br /> <br />G. p.p.m.: parts per million. <br /> <br />H. ~ the logarithm of the reciprocal of the weight of hydrogen ions in <br />grams per liter of solution; a stablized pH will be considered as one <br />which does not change beyond the specified limits when the waste is <br />subjected to aeration. <br /> <br />I. Suspended solids: solids that either float on the surface of, or are <br />in suspension in water, sewage, or other liquids, and which are removable <br />by laboratory filtering. <br /> <br />J. <br /> <br />Normal wastes or normal sewage: <br />exceeding 300 p.p.m. B.O.D. nor <br />materials expressly excluded in <br /> <br />liquid waste with a strength content not <br />400 p.p.m. suspended solids, except those <br />Paragraph III. A., infra. <br /> <br />K. Industrial wastes: liquid waste, other than normal sewage which exceeds <br />300 p.p.m. B.O.D. or 400 p.p.m. suspended solids. <br /> <br />L. Person: any individual, firm, company, association or corporation, <br />including public agencies. <br />
