<br />(5) That all supplements to said Uniform Statewide Building Code
<br />be, and the same hereby are, adopted by reference as a part of this
<br />ordinance.
<br />
<br />Also, upon motion (duly seconded and unanimously carried), Council adopted the
<br />
<br />following ordinance requiring members of the City's fire-fighting forces to
<br />
<br />undergo physical examinations pursuant to Section 27-40.1 of the CODE OF VIRGINIA
<br />
<br />(1950, and as amended):
<br />
<br />WHEREAS, Section 27-39 of the 1950 Code of Virginia, as amended,
<br />states that any city which operates fire-fighting equipment may provide
<br />for the relief of (1) any children and widow of any fireman who dies (2)
<br />and for the relief of any fireman who is disabled by injury or illness
<br />while in the service of said city; and,
<br />WHEREAS, Section 27-40.1 of said Code provides that the death of,
<br />or any condition or impairment of health of salaried or volunteer
<br />firemen caused by respiratory disease, hypertension or heart disease
<br />resulting in total or partial disability shall be presumed to have
<br />been suffered in the line of duty unless the contrary be shown by
<br />competent evidence, provided that prior to making any claim for such
<br />benefits based upon such presumption such salaried or volunteer firemen
<br />shall have been found free from respiratory diseases, hypertension,
<br />or heart disease by a physical examination which shall include such
<br />appropriate laboratory and other diagnostic studies as the governing
<br />body of said city shall prescribe and which shall have been conducted
<br />by physicians whose qualifications shall have been prescribed by such
<br />governing body; and,
<br />WHEREAS, Section 27-40.1:1 of said Code provides that any city
<br />furnishing any of the benefits pursuant to the authority of Section
<br />27-39, or pursuant to any other provisions of law, or otherwise,
<br />shall by ordinance make provision for the employment of physicians
<br />and the performance of the physical examination required by Section
<br />27-40.1 and shall cause such examination to be made within 90 days
<br />after June 1, 1973, or as soon thereafter as may be practicable,
<br />of every fireman in its service and of every fireman entering upon
<br />such service thereafter at the time of such entry; and,
<br />WHEREAS, the City of Martinsville, Virginia, furnishes such
<br />benefits to its firemen as necessitate the performance of the physical
<br />examination required by Section 27-40.1; now, therefore,
<br />BE IT ORDAINED by the Council of the City of Martinsville, Virginia,
<br />in regular session held on August 28, 1973, that every fireman,
<br />either salaried or volunteer, in its service, on or before September
<br />1, 1973, or as soon thereafter as may be practicable, and every fireman
<br />entering upon such service thereafter at the time of such entry,
<br />shall, at the expense of the City of Martinsville, Virginia, undergo
<br />the physical examination required by Section 27-40.1, as aforesaid,
<br />by a physician licensed to practice medicine in the State of Virginia,
<br />which physical examination shall include the examination of the eye,
<br />ear, nose, and throat, the glandular system, chest and lungs, heart
<br />and abdomen, inguinal area, the extremities, blood pressure sitting,
<br />radial pulse, peripheral pulse, and a general neurological examination.
<br />In addition, such examination shall include a routine urinalysis,
<br />hematocrit, blood serology, large chest x-ray, a twelve lead
<br />
<br />e~ec~ro-cardiogram, and any other specialty tests indicated by abnormal
<br />f1nd1ngs from any of the foregoing tests. The physician conducting
<br />
<br />said examination shall submit a report thereof to the City Manager,
<br />
